OK, we've probably all seen a website about, or heard about stupid sex laws, but these websites never give sources, or the actual state code they got it from, so it's pretty safe to say 3/4 of them are bullshit. Well, I decided to do my own "mythbusters" and find the truth behind each states sex laws.... And while I didn't find anything crazy, like "in utah the only position you can legally have sex in is the missionary" (it's not), I did find some surprising things. And if you live in one of these states you should write your congressman and urge him to fight to have these laws repealed. So here goes.... I went to every states legislative website and looked through their statutes and laws, so you can do the same if you want, I even provide you with where the statute is located.... I had to go through all fifty states by myself, so I wouldn't be surprised if I missed one or two things. If so feel free to post one you know, as long as you have the actual statute or code number. SEX TOYS In the following states it is illegal to sell or distribute "any article, object, instrument or device used for stimulation of the genitals or which may be found to have a souly prurient intrest" : Alabama: Title 13A, Chapter 12, Article 4, Division 5, Section 13A-12-200.2 ,Class C Felony Georgia: Title 16, Chapter 12, Section 80 Mississippi: Title 97, Chapter 29- 105 Texas: Title 9, Chapter 43, Section 43.23 states it is illegal to distribute sex toys, but also says that possession of SIX OR MORE sex toys constitutes intent to sell.... so if you live in Texas you better count up your dildos. ORAL AND/OR ANAL SEX It is against the law in the following states to engage in oral, or anal, sex, whether with a person of the same, or a person of the opposite sex. And as they state: "marital relationship is no defense". Florida: Title XLVI, Chapter 847.001 and 800.02 Georgia: Title 16, Chapter 6, Section 2 - Sodomy Idaho: Title 18, Chapter 66, Section 18-6605 Crime Against Nature- "Any person convicted of this crime is subject to imprisonment of NOT LESS THAN FIVE YEARS" Louisiana: RS 14:89 Crime Against Nature Massachusetts: Title I., Part IV, Chapter 272, Section 34 - Crime against Nature, subject to imprisonment of no more than 20 years Mississippi: Title 97, Chapter 29, Section 59 imprisonment no more than 10 years Minnesota: Chapter 609.293 Montana: Title 45, Chapter 5, Part 5- 505 North Carolina: Chapter 14, Subchapter VII, Article 26 14-177. Crime Against Nature, punished as CLASS I FELON Oklahoma: Title 21, Chapter 34, Section 886 Crime against nature, no more than ten years South Carolina: Title 16, Chapter 15, Section 16-15-120 Utah: Title 76, Chapter 5, Section 403 Sodomy, Class B misdemeanor Virginia: Title 18.2, Chapter 8, Section 361 CLASS 6 FELONY Michigan: Michigan can actual charge you with TWO crimes here 1) Code 750.338b - Gross Indescency public or private, and 2) Code 750.158 - Crime Against Nature. Both of which are FELONYs SAME SEX ORAL AND ANAL These states outlaw oral and anal sex, but only if it's between members of the same sex. Arkansas: Title 5, Chapter 14, Section 122 - Same Sex Sodomy Kansas: Chapter 21, Article 35 Code 21-3505 - Same sex sodomy, Class B misdemeanor Kentucky: KRS 510.100 - Same sex sodomy, Class A Misdemeanor Texas: Title 5, Chapter 21, Section 21.06 - Deviate sexual behavior with members of the same sex Vermont: Title 13, Chapter 5, Section 205 - Fornication by persons prohibited to marry (i.e. homosexuals) UNMARRIED SEX These states have laws against fornication (two unmarried persons haveing sexual intercourse) and/or cohabitation (two unmarried persons living together as though husband and wife) Alabama: Title 13A, Chapter 6, Article 4 Section 13A-6-65 - Deviate sexual intercourse -Class A Misdemeanor Georgia: Title 16, Chapter 6, Section 18 - Fornication Idaho: Title 18, Chapter 66, Section 18-6603 Fornication Illinois: 720 ILCS 5/11-8 - Fornication, Cohabitation "if act is open and notorius", class B misdemeanor Massachusetts: Title I, Part IV, Chapter 272, Section 18 - Fornication Mississippi: Title 97, Chapter 29-1 - Fornication/Cohabitation Minnesota: Chapter 609.34 - Fornication North Carolina: Chapter 14, Subchapter VII, Article 26 14-184, Cohabitation/Fornication, Class 2 Misdemeanor North Dakota: Chapter 12.1-20-10 - Cohabitation- Class B Misdemeanor Florida: Title XLVI, Chapter 798, Code 798.02 Cohabitation Michigan: Section 750.335 - Lewd and Lascivious Cohabitation Virginia: Title 18.2, Chapter 8, Section 18.2-345 and 344 - Fornication, class 4 misdemeanor. Cohabitation, class 3 misdemeanor. Repeat of either offense, class 1 misdemeanor. West Virginia: Title 61, Chapter 8, Article 61-8-4 and 3 South Carolina: Title 16, Chapter 15, Section 16-15-60 and 80 - Fornication and Cohabitation Utah: Title 76, Chapter 7, Section 104 - Fornication, class B misdemeanor OTHER Some other misc. laws that you might want to know about if you live in any of these areas: Arizona: Title 13, Chapter 36, 13-3605 "A person who willfully writes, composes, or publishes a notice of advertisment of any medicine or any means for prevention of conception is guilty of a misdemeanor." North Carolina: Chapter 14, Subchapter VII Article 26 14-186 - "Opposite sexes occupying a hotel for immoral purposes" North Carolina: Chapter 14, Subchapter VII Article 26 14-190.5 - "Preparation of obscene photographs, slides, and motion pictures." Michigan: Code 750.532 - Seduction "Any man who shall seduce and debauch any unmarrried woman shall be guilty of a FELONY Houston, Texas: Section 28-14, Prohibits renting premises to lewd female for immoral purposes. Houston, Texas: Section 28-15, Prohibits bringing persons together for purpose of lewdness Massachusettes: Title I, Part IV, Chapter 272, Section 21 - States that you may not provide any person with the means to prevent pregnency, with the exception noted in Article 21A. When you look at Article 21A, you find that "A registered physician may administer to or prescribe for any married person drugs or articles intended for the prevention of pregnancy or conception." So according the letter of Mass. law, you must be married in order to obtain birth control. These are all the laws the make it fairly obvious as to what it's refering to. There are many other laws I found that were like these, but that were obscure in their meaning, such as one in VIRGINIA that forbids the sale of "any obscene figure, object, article, instrument, or novelty device". Are they talking about sex toys, or not? You be the judge NOTE:The supreme courts DID rule sodomy laws unconstitutional, so the chances of getting convicted are nil',but these states still have the laws. But all the laws on cohabitation, and fornication still stand. In fact there is a battle in North Carolina, because they refuse to drop their cohabitation law... even though there are 100,000 people breaking it right now. The sex toy laws have been back and forth, but as of right now still stand in those states.
And if you do live in one of these states, don't blow these off with a "Oh, they'll never in force that".... Ask the woman in North Carolina who was fired from the Sheriffs department because she lived with her boyfriend. Ask the two kids in Michigan who were charged with Seduction. Or the man in Atlanta who was convicted of oral sex.... His ex-wife took him to court and said that he once tied her up when they had sex, and because he tied her up the sex wasn't consenual. When the womans sister got on the stand and testified that the woman had told her of a scheme to send her husband to prison, the rape charges were dropped..... but because during the course of testimony the man said he went down on his wife during it, he was convicted of sodomy and went to prison. Or the kid in North Carolina... the cops busted in thinking they on a drug bust and found a guy and his girlfriend fucking around... turned out they had some bad info and there was no drugs... the cops were pissed they didn't get their big bust, and stuck the two with three misdemeanors 1)sodomy 2)fornication 3) cohabitation

luckily all of those laws are illegal as per a supreme court decision in 2003 declaring any law that regulates consentual behavior violates the penumbra of privavy in the bill of rights. cool thread idea though
