It is part of the executive branch, under the authority of the President, and the Administrator can be fired by the President without cause. It's called "independent" in the same sense EPA is called that. It's not part of a cabinet-level agency, although it is subject to guidance from the State Department. You seem to be confusing it with an independent regulatory commission like the FCC. Your standing to call anybody stupid or further comment on American politics is hereby revoked.
