Oregon Lawmaker Who Let Protesters Into State Capitol Is Charged in Breach

"A Republican state legislator from Oregon who was captured on surveillance video allowing demonstrators to enter the State Capitol in December was charged on Friday in connection with the breach of the building, which led to a conflict between officers and protesters.

The lawmaker, Representative Mike Nearman, 57, was charged with official misconduct in the first degree and trespassing in the second degree, according to court documents.

Marion County prosecutors said in court documents that Mr. Nearman, “being a public servant, did unlawfully and knowingly perform an act which constituted an unauthorized exercise of his official duties, with intent to obtain a benefit or to harm another.”

On Dec. 21, while legislators were in session, Mr. Nearman calmly walked out a side door, allowing several demonstrators, many of them unmasked and holding American flags or pro-Trump signs, inside the State Capitol, in Salem. The moment was captured by widely circulated video surveillance of the breach."

State troopers and Salem police ultimately prevented them from entering the building’s rotunda or reaching the House or Senate chambers, but not before some of the rioters allegedly sprayed six troopers with a chemical substance that was reportedly pepper spray. The video shows spray being deployed.

Some demonstrators physically attacked journalists who were reporting on the event. At least one person was arrested after trying to enter the Capitol by breaking the window in a door. People also gained entrance without breaking in — and this security footage shows exactly how.

At least two people have so far been arrested on charges related to the breach on the morning of Dec. 21."

 

Republicans known for professing 'law and order' went quiet on the incident.

"House Speaker Tina Kotek said on Thursday that legislative leaders were exploring how they could sanction any lawmaker who aided rioters in forcing their way into the Capitol on Dec. 21. Oregon State Police are investigating the incident, she said.

So that's what he gets for opposing Trump, who still holds a lot of power in the GOP. Any Republican with sense enough to believe their party needs to move past Trump is made a pariah. The mid-terms are a year and a half away, hope we vote some more of them out of office, especially ones that the orangeman campaigns for. Maybe then they'll wake up. Maybe.

"There can be no question that the execution of a search warrant at Giuliani’s residence is a serious step that indicates the criminal investigation against him is far along. Federal prosecutors can’t obtain a search warrant based on a hunch or mere suspicion. They had to present substantial evidence to a federal judge that there is good reason to believe that a federal crime was committed and that evidence of that federal crime was located in Giuliani’s apartment and his electronic devices. It’s significant a judge was persuaded they met that standard.

For that reason, prosecutors likely have a lot of the evidence they need already. During my time as a federal prosecutor, when I sought a search warrant for a subject’s electronic devices, typically I had already obtained some of the subject’s communications or electronic documents from other sources such as cooperators, subpoenas or prior search warrants. I used that evidence to persuade a judge that those communications would also be found on the devices. Even though prosecutors have some communications prior to obtaining electronic devices, the devices can contain more data, including deleted messages, metadata and location information."
