Pence has opted for a claim of legislative privilege related to the "speech or debate" clause.rather than executive privilege.

Pence was presiding over the U.S. Senate when he was counting the electoral votes for the 2020 election. He was subject to pressure by Trump to not certify Biden's win. He is claiming legislative privilege for a legislative duty that is related to the DOJ's apparent investigation of Trump's behavior toward Pence that involved that duty.

 

The fact that Pence has opted for legislative privilege indicates that the DOJ is interested in Pence for matters related to Trump trying to overthrow the 2020 election rather than the classified documents investigation. Or at least Pence anticipates that or has inside information about the DOJ via his attorneys.

If the DOJ is currently after Pence for the classified documents case, Pence would have opted for executive privilege instead of legislative privilege.

Pence could also invoke executive privilege to try to defend himself and Trump. Various Trump administration officials and associates have already done so with most losing in court.

 

Pence doesn't want to be outdone by Trump and DeSantis in culture wars.
