Pence might not be eligible for the second debate. He's lucky if he is eligible for the first. Considering the distance the competitors are lagging Trump, if the GOP makes the requirement even more stringent, Trump may be the only one eligible. And he might not even show up, leaving the stage empty.
States have such protections in place to prevent people like Trump from abusing the election system. If they didn't or if they weren't sufficiently stringent, Trump would take advantage of it. In a situation where the state laws were later changed to prevent his abuse, Trump would claim that he was right and legal all along because the states had to change the laws to prevent his abuse. Trump made this type of remark after the Electoral Count Act of 1887 was revised by Congress after he tried to use some of it's ill-defined passages about the VP's role and its very low-bar requirements (only one member of U.S. House and Senate needed for contesting a state election) to try to overthrow the presidential election.
