When I was arrested in May, I was pulled out of my car for an unknown reason. I had my hands in my pockets, and when I removed them it revealed a box of Hav-a-Tampa Jewels,(tipped cigars). The cops asked me if I could empty my pockets, but told me it was not required. I unloaded the contents from my rear and side pockets. My weed was in a lower cargo pocket down my leg. After I emptied the contents of my other pockets, nothing of which was usable for evidence, the cop saw the top end of a plastic baggy in the cargo pocket. He made the comment, "What's that?", but before I could answer he replied, "Don't worry, I already know what that is", and he took it out of my pocket. At first I didn't think anything of it, but when I got released from jail, the baggy they gave me for my belongings was identical to the baggy the weed they found was in. There is no way he knew it was weed in that bag by just viewing the top of it spiralled up. What I need to know is this: By emptying my rear and side pockets, did I give him permission to search me, or did he in fact perform an illegal search of my remaining pockets? Keep in mind that he never once did a 'frisk' or a 'pat down' so he had no idea what the contents of that pocket felt like.
