we video taped ourselves smoking weed on our friends camera who is on formal probation, his room was searched and the tape was confiscated by the police. can devan be prosicuted if he's not the one on probation?
idk i had a buddy whos college roomate raped a girl in there room(my friend wasnt there) when the cops where investaging they found video tapes and watched them. One tape had pictures of me and my krew around a 3 liter poland springs grav bong lol. They never prosecuted any of us for it but that may of just been because they where to involved with the rape case to waste there time.
yes. anyone who is on the videotape with the posession of weed can be prosecuted (i don't think its illegal to smoke it and i know it's not illegal to be high). now your friend is not required to give the police devan's name and im pretty sure they wouldn't waste their time trying to find him with just his face on a video.
unless they actuly see the pot that your smoking they cant do shit if your just passing a joint or hitting a pipe it would be anything unless you actuly zoom in of the weed and then watch it being put into the pipe and smoked

i think its illegal to smoke it or be high, the thing is that you cant easily be prosecuted because it's hard to prove on the spot. pitpat, i dont see how your friend could get into trouble for the tape, because, as other people said, he could deny that it was marijuana, as long as he didnt talk about it on the tape. not positive though.
noone can be prosecuted period, if they caught you in the act of smoking, with weed in your hand yes, on a vidio no.. you can walk right up to a cop & say i just smoked a ton of weed, if that weed isnt on you they cant do a thing its not illegal to "had" smoked..past tense..its only illegal to be smoking however, the probation violation is different, if its in his system, hes screwed whenever i get pulled over & asked if theres weed in the car i say no sorry, we just smoked the last an hour ago..do you have any ya could spare for the road? & they usualy chuckle & make a 1/2 assed aparance only look around & move on you can vidiotape yourself smoking & post it all over the web & tv & theres nothing thy can do...unless its a "live" feed & they catch you with it on you
video tape is solid evidence... its much different than spoken words... you can see it happening and if there is volume.. they can hear it happening.. i guess depending on what state you are in.. they could blood test the kid.. and prosecute him... because like i said.. its solid evidence that he is smoking.. its not an illusion.. its not a story... the proof has been video taped.. and if you actually say "marijuana" or possibly any other popular slang for marijuana on the video im sure your chances increase... but its still a good question.. i guess it could easily go both ways... its like say you're arrested on suspision of dealing and they find a paper with names and $$$ amounts listed for what they owe... that is solid evidence... unless you can pull one hell of an excuse out of your ass
Pitpat, If indeed you and your friends are in Ca they would need to catch you with more than one ounce of pot in your personal possesion in order to do more than give you more than a one hundred dollar fine Your friend on probation is a different story though. They can give him a blood test and violate his probation if they so chose. To do much more they will need to be able to prove it was indeed pot and who's it was and that the amount was more than 1 oz. It seems to me this would require singed statements by more than one person who was present. Two things to keep in mind; your pal on probation might be pressured into making a statement because he's in a bad situation and at their mercy, but he's only one person and also be aware that some cops will tell you anything to trick a confession out of you. Don't listen even if they say everyone else has confessed, listen and talk ony to your lawyer. Good Luck....
This kinda thing has happened to me before. It turns out that if you are just videotaping yourself smoking weed it isn't illegal beacuse the cops cannot prove that it was weed. The only time a video like that could be a factor is the fact that the cops know you are a stoner and if you are cought with weed it can be used as evidence against you. See, this is how it goes: it's illegal to possess, it's illegal to sell, it's illegal to smoke (because you would have it in your possession).
