the new banner on these forums...all of the products that are illegal to sell in america have a disclaimer saying they cant be shipped to the the US, but marijuana seeds dont have this disclaimer. Is it a given that they arent to be shipped to the US, or is it legal to buy seeds? http://www.shayanashop.com/default.aspx?referid=hipforums
it is not entirely legal, but you're very unlikely to get caught, and if you do get caught you're almost surely not going to actually get in trouble.
All I know is from High Times. On the pages where seed vendors advertise in High Times it always has a disclaimer at the bottom of the page that says "the aquisition of live cannabis seeds is illegal in the U.S." I always presumed it to be true.
It's legal to ship from elsewhere, but not to posess cannabis in America. I presume everyone KNOWS that by now. Cannabis seeds are cannabis and therefore subject to the same laws and restrictions. I might remind everyone that this is an INTERNATIONAL website and that for most countries purchasing cannabis seeds is not an illegal act. Only backwards, fascist countries place such draconian restrictions upon their citizens... It disturbs me when I hear Americans complain about activities that take place outside America, as though there is only one country in the world, or with the thought that American law superceeds the rest of the world (a common problem with America & it's leaders) BTW, i'm not referring to anyone in this thread. However, I will point this omission out to the company. Hopefully they can add that disclaimer.
My friend's mom's dealer got busted with over 2,000 seeds in his car and is now on probation and can't smoke, but I got to smoke with him on his last toke session that he is not going to have again for awhile.
be careful, read about marc emery seed's the same could be said about people living outside the U.S. complaining what we do here...
No you got it wrong (as usual), Cadcruzer. People overseas couldn't care less about what Americans do in America. It's what America does to the rest of the world that is of great concern to those overseas, especially those who are victims of American military aggression, CIA coups, secret prisons, torture, trade quotas, economic embargoes, etc., etc. So you see, it's a different case entirely.
as usual your only 180 degrees off... it is ILLEGAL to buy seed's here in the state's, it is also illegal to sell seed's to some one in the u.s.a., see marc emery........it also disturb's me when someone outside the U.S.A. sit's back and bitch's about everything that comes down the pipe, when they themselves dont live here. same as it bother's you when someone here "u.s." bitch's about activities outside the u.s, guess that makes it a 2 way street.
Ah yes, in Emery's case the US is attempting to manipulate the policies of another sovereign nation, and failing that, launches a vendetta upon it's own people. That's right I suppose, since the US is now prosecuting those who sell outside, but I understand there was some other law broken within the US that caused Marc's prosecution, wasn't it? Marc did not violate Canadian laws. Can someone shed some light on that (my memory fails me...hehe) As far as complaining while not living there, did you consider that due to my complaints, I just followed conservative advice to Love it or leave it, since there seems to be no middle ground allowed in America anymore...
Anyway I'll get back to you on the disclaimer, cause i was wondering about that too, and since I did see the disclaimer for mushrooms, I figured they were operating legally. In fact I think it would be hard for the US to prosecute them as Dutch & British seed companies send thousands of orders into the US every day. I do think a disclaimer of some sort is in order.
i believe "emery" sold seed's to an undercover f.b.i. or d.e.a. agent's twice, also giving them specific info on how to make it thru custom's. last i heard he had 30+ charges for selling to seed's to the u.s. , my guess would be to undercover cop's.they confiscated his comp's ,so now his mailing list's are in their hands too. he claim's they were deleted after a period of time, but i bet the gov. geek's are having a hay day. btw sensi seed shop WONT sell seed's to the u.s., australia, part's of asia, germany, luxembourg, norway or any other countries where traffic of cannabis seeds is considered illicit.
By UN treaty, weed seeds themselves CANNOT be illegal; indeed, they are protected as being potentially essential to humanities survival. Conspiracy to grow marijuana IS illegal, however. So ordering seeds cannot get you arrested UNLESS other elements of conspiracy are evident. Emery is viewd as engaging in a conspiracy to produce an illegal product- by the US AND canada. And, of course, that's exactly what he's been doing, as he sells seeds with the stated purpose of producing an illegal crop.
I've heard back, and they have a disclaimer that a purchaser must agree to before purchase. Here it is: http://www.shayanashop.com/general.aspx?action=disclaimer So I think that covers it, no? If not, contact: info@shayanashop.com
