In a very liberal decision that changes the way crime is viewed in Canada, the Supreme Court OK'd group sex in clubs. Saying that the activity in no way threatens society, they raised the bar and set a new standard for what can be prosecuted under Canadian law. ""Criminal indecency or obscenity must rest on actual harm or a significant risk of harm to individuals or society" - Canadian Supreme Court It seems that now only activities that are a threat to society or an individual can be prosecuted. So victimless crimes such as marijuana smoking, may now be reconsidered as not harming society as a whole. Canada has gone it's own way on social issues, often angering the US government with it's liberal attitude towards sex and drugs. Hopefully this will make a lot of minor marijuana arrests pretty pointless. I think that using the Gay Marriage and this Group Sex reasoning of "It doesn't hurt society" would probably work in getting most peoples' asses out of some serious trouble.
I'm not sure how far the court is willing to run with this ruling as applied to other issues, or whether the court has ever used this kind of reasoning in Canada before, but lawyers could now use the ruling as a prescedent for other cases.
I believe this to be a positive change. The state has no place in the bedrooms of the nation. Or, in this case, the bedroom-analogues of consenting adults. ... booya kasha!
I was out there when gay marriage was made legal, it was such a great time to be in Victoria. sp much celebration. it made me so happy to see a country taking a modern and liberal view on life. made me want to move out there even more.
