    My buddy John calls me up this morning and tells me he's getting sued for a car accident that happened before I met him. He asks me to guess how much the lawsuit is for, and I say $250,000. He says it's a little higher, so I guess $275,000. He then tells me it's for TEN MILLION DOLLARS. He has to meet with his lawyer on thursday to see if the lady will settle for $100,000 which is as mush as his insurance will pay. He fucked up this lady's leg, broke it in like four places. I think he said he fell asleep on his way back from work. He worked the night shift at a grocery store that I worked at. I was hoping he'd never get the call, this happened like four years ago. He got the call this morning. I hope everything works out because he sure as hell doesn't have ten million dollars.

    hmmm, falling asleep at the wheel isn't very clever

    I've never understood the whole let's-sue-everyone mentality so many Americans (not all, just many) seem to have. C'est bizarre

    I'm not defending him, but shit happens. I just can't believe he's being sued for so much. I mean if I was going to sue someone for ten million dollars, I'd make sure he had it first. I'm betting she'll settle for a hundred thousand though.

    thats about what our client who accidentally shot and killed someone was getting sued for, hmmmmmmmmm.......maybe a more. she must not be able to work or something.

    That is a crazy amount of money. What would he do if the court ruled in her favor?

    He could always go bankrupt and the woman wouldn't get a penny....:D. ha; it's funny how the judicial system works really; but seriously, it's the truth.

    That sucks big time but you can't get blood from a stone.. if the woman wins, good luck collecting ten million.

    It used to be that people dealt with what life handed them and made the best of things but since our court system has been turned into a lotto for the greedy...

    so what the forking hell did he actualy DO (or is supposed to have done) that someone thought they could ask the court for that much of someone else's blood? did he premeditatedly commit vehicular manslaughter or something. since you didn't say anything about crimminal charges i'm assuming not. did he deliberately run over their dog? or was he simply distracted momentarily from responsibly complete control and someone trying to exploit that he might have been?

    i've heard of scams where people cause accidents that are then the legal responsibility of their victums just so they can pull this kind of law suit bussiness. is this one of those things.

    the fact that someone is being sued what seems like an outragous amound doesn't really say very much without a little bit of some kind of context

    the way i look at it....

    what is the amount for?
    i mean look at it. 10 million, for what? this was ended long ago when some "person" walked away from mcdonald's with several million for burning themselves on a cup of HOT coffee. not saying the victim isnt suffering, but be reasonable, lets say she cant work, and has to start from nothing, do the math, 250 for house and everything after that is gravy, dont need a car cause you're "appearantly" disabled, so that leaves maybe a million for living comfortably the rest of your life.

    but here is what gets me,
    there is a little thing on your insurance, called DISSABILITY, everyone is required to have at least coverage of the other person on their insurance.
    and this may differ state to state, but at least every state i have seen is like this

    so every driver has at least coverage of the victim if they are at fault,

    that is what insurance is...
    so this dude needs to check with them,
    yes they do have a cap on that, but that is where the judicial system is supposed to come in,

    10 million? say what you want,
    that just says greed to me

    People always sue for the max that their lawyer says is possible. They rarely ever get THAT much.

    Chances are, she'll settle, or it'll go to court and he'll have to pay probably an eighth of that.

    I don't really know what happed to the woman, I'm sure it caused her a lot of pain. I haven't talked to my friend about it in a while, he moved to the ocean last summer which is about 200 miles away. I haven't seen him in months, but he's coming back tomorrow because he has to meet with his lawyer, and he's going to see Jerry Seinfeld on Friday. He's doing stand-up in Baltimore. We will be chilling sometime tomorrow, I'll fill you guys in with details after I see him. All I know for sure is that this woman is not going to get ten million dollars out of him because he will never have it.

    your buddy should be fine. My mom was rear-ended at 40 mph about 4 years ago. It left her with whiplash and a pinched nerve in her back. Due to the pinched nerve one of her legs went numb in the middle of the night and while she was on her way to the bathroom she fell forward and broke her foot. Ironically enough it happened to the other foot as well. She had to have back surgery on top of everything. After all of this, missed work, doctor bills, and the hardship on her life, she was awarded 75,000.


    Your buddy should be fine.

    Yeah I know he won't have to pay ten million, I'm sure that it will be settled for $100,000. I just can't believe this happened to him. He's the nicest guy I know and even though he fucked up and it is his fault, he doesn't deserve this.

    I was hit by a girl on my motorcycle, who took off.

    Didn't even get $20,000.

    Lawyers can ask what they wish, but in most places the insurance people have whined about having to pay more than simply the medical bill.

    Lawyers ask what they want because they get one-third. They're not really suing your buddy, they cant. They HAVE to sue the insurance company but can name him as a co-defendant especially if his coverage caps below the damages they are seeking. I wouldn't worry much.

    On the subject of us litigious 'mericans, we really need both litigation reform and tort reform, much like the UK has. If you sue someone and you lose, you have to pay court costs, still have to pay your own attorney, and you leave yourself open for defamation/slander lawsuit.
