Infared Cameras: Ruled Unconstitutional?

I remember reading in Time magazine or Popular Science or one of those that some guy got caught growing in his attic from choppers with IR cameras. He fought it in court though, and the charges were dismissed on the grounds that without a warrent the evidence was unadmissable seeings it violated the 4th Amendment. Does this precident still stand? (oviously in the US)
