Ok, I'm going up north to go camping next week, and have to drive 5 hours to get there. I want to take some weed with me, and was just wondering about car searches. Can a cop search my car without a warrant, if he just pulls me over for speeding or something? I mean, I don't speed much anyways, but you never know, Michigan State Troopers are assholes. I've heard that cops can't search without a warrant without consent by the driver, but I've also heard that he can. Long ago I tried finding out from a Michigan legal code, but they don't really spell that kind of thing out, and I gave up looking pretty quick.

And is there any good place in a car to hide weed that is unlikely to be searched? I have a 94 Ford Ranger with extended cab. I've never driven very far with weed on me, and am a little paranoid.

    Any help would be appreciated.

only if they have probable cause...say the car smelled like bud smoke...thats probable cause, but if they pull you over for just a traffic violation they cant search your car...unless you agree to let them, dont ever give them your permission no matter what they say.

they like to play the whole..."well if you have nothing illegal you wouldnt mind me lookin"...tell them to fuck off using whatever words you like but dont agree

As long as you don't drive too fucked up or speed you should be fine. We drove From NJ to canada with weed and got it through the border and we were smoking the whole way there and we were fine.

I was comming home from a concert with a friend about a month ago and we got pulled over by a statie-and MA state cops can be real a-holes. He came over to our window and asked if we'd "Been smoking any marijuana tonight" we said no, then he asked if we had any in the car, at first we said no but then we admitted to having a blunt, he made me get out of the car and squish it. He told us to leave the windows down so our parents didnt smell it and sent us on are way lol and I've gotten pulled over stoned many other times and never gotten called on it, as long as your careful you should be fine
    Peace

lol, why would you admit to having a blunt??

anyways, cops can't search without probable cause or the drivers consent. never consent to a search. if they try to search you're car because saying no is suspiscous, let them know very clearly that it's illegal, and that you want to speak to their supervisor, otherwise theres gona be lawyers involved and hes losing his job. that'll make em think twice..

i always hid it in a panel. pull it off and stash it, and then just put it back on.

im just always afraid of the dogs....damn dogs..

im sure you can find heaps and heaps of places in seat material or something. i mean, as long as your not carrying like a pound or something. unless theyre really suspicious, cops cant be btoehred searching everything. also, if tehres seats in the back, put heaps of luggage and stuff there, caus then if the cop does search you, theyd have to move all teh stuff (you dont have to if you dont want to, i dont think they can make you) and how many fat cops can u think of whod bother that for a little posession ticket.

Thanks, everyone, you've all helped me feel a lot better. I just didn't know if I had the right to refuse the search, legally, without them coming up with other charges against me; like you can refuse a breathalizer test, butif you do, you lose your licence...that kind of thing.

someone was telling me last night that it´s better to have everything on your person and not in the car somewhere. i forget why exactly, but that´s what he said and it sounds right to me.

just make sure to keep everything together and in one good spot. i´ve driven from Wisconsin to Maine with lotsa shit on me, as well as other long distances. i even recently got pulled over for speeding when i had a variety of things on me. i probably wounldnt be here right now if that cop had found any of that...

I have never been pulled over before, but I have seen alot of episodes of cops. When they take a guy out of a car they always pat him down, but they never search the car. So I never have weed on myself when I am driving, I just hid it in a good spot in the medical kit in the back. But you won't have your car searched and you won't have to get out of the car for a speeding ticket.

Without cause, a police man may "pat you down" for a weapon.

But when he feels that bag of buds in your pocket and tells you to take it out, just say NO. It'a clearly not a weapon, and he has no legal authority to compel you.

If he pulls you and wants to bullshit, telling you're going and leave. Don't be polite. He's stalling you until a dog gets there.

If a cop pulls you, ask him what the problem is. If he doesn't begin writing you a ticket, ask if you are being detained. If he says no, split. If he says yes, you have the right to remain silent.

do not cooperate beyond ID and the matter at hand.

If you discuss the weather or the game, he'll suck you in to a search. Remember, he's a pro.

Most cars are searched by permission of the driver.

Eh, It's better for the people who don't have it on them, but for the dude who does its MUCH worse. If a cop pulls you over and searches you and it's all on one guy, he gets charged for it all and everybody else gets away scott free, but if it's in the car somewhere and they find it, everybody get's charged for it, so in some ways it is better, but good luck finding the dude who's gonna keep EVERYTHING on him and take the blame.

    Peace and Love,
    Dan

A few months ago I was pulled over in NY for doing 61 in a 55. I was with a cpl friends had a bottle of whisky in the backseat and we were in the process of smoking a jay which we had to throw out the window [IMG]. The cop took my license n evrything then came back and asked me to take the breathalizer I did so knowing I hadnt yet drank and blew nothing. He then told me to step out of the car he smelt pot plus seen the bottle+we were all underage. He didnt find anything on me little did he know there was about 60$ of budz right in my boot. After searching my friends all he could come up with was the speeding ticket and illigal possesion of alcohol. After going to court all I had was a 50$ fine for the booze guess it could have been worse. So my best opinion when driving and carrying is to either keep it in your pocket or if you feel paranoid/going long distances your shoes usually go uncheckd w/ many officers jus tuck it in the side.

there are more legal restrictions on a search of your person than a search of your car.

I assume that means I'm being arrested. Can a cop detain me if I'm not under arrest? I mean, couldn't he say I'm being detained to wait for the dog?

    yes and no.

He can detain you without arresting you if he has probable cause to search you or your vehicle. In other words, he must have probable cause to detain you.

If you run a red light, the cop has probable cause to stop you and write you a ticket. Nothing more. Don't give him an excuse for anything more.

Waiting for dogs (or superman or sunrise) is not considered probable cause for detention by the Court (HooRay! for the good ol' US Constitution!) and every cop knows it.
So "STAY HERE AND WAIT FOR THE DOGS MOTHERFUCKER!!!" from a cop is to be considered a polite request- just say no. Adios, porcos!

If your talking to a policeman dont make conversation with him about anything other than why he's pulled you over. talk to him in the same tone of voice and in the same way as you would talk to a friend (obviously not about anythin you shouldnt have on you ie, weed) and never look scared or nervous if you do start to feel nervous start thinkin about somethin that makes you happy. Trust me when it comes to lieing about somethin im a pro :p

it's pretty easy, depending on the amount of tree there is, for a girl to put it in her pants or in her bra if need be. had to do that a couple of times. but make sure you can trust the people you're with...if they have weed on them and you get pulled over, make sure they don't just stuff it somewhere in your car. what, if anything, the cop finds in your car (not on a person), you could be charged with.

It is fairly easy to search the drivers person "for officer safety."

It is best to keep it in a locked suitcase in the trunk (the more locks between the cop and the stash the better the legal situation.)
If the cop asks "Whose case is this?", answer. That gives you ownership of the suitcase and therefore authority to grant or deny consent for a search.

If the cop askes for ID, give it to them. (Even if you are a passenger)
DO NOT lie to a cop. Refuse to answer if you choose to, but do not lie.

If the cop desides to search, DO NOT physicaly interfere with the cop. Do not touch the cop, the cop car or any cop equiptment. (Touching the car can be interpreted as assault on an officer.)

    Repeat after me,
"I do not give consent for a search."
"I don't want to answer any questions, I want to talk to a lawer."

All of this will be interesting in court, but on the street; its best to relax, be friendly and not consent to a search. On the street, the cop will do what the cop wants to do. Don't be stupid.
