If someone were to smoke outside your house, not on your property, and the smoke came in your house, would you have the right to tell that person to leave the area when they're smoking? What if it's your next door neighbor? Do you have the right to tell them to go elsewhere even though they're on their own property? Or do you just keep your mouth shut and close the window if you dont want the smell in your house?
My friend is having an issue with her neighbor right now. Just want some opinions. Thanks :)

My opinion is certainly not needed nor wanted, but I strongly dislike all those anti-smoking fascists.

The wind is blowing that direction. Not my problem. I don't allow smoking in my house, nor do I smoke in my house. Mainly because I do not care to smell smoke constantly despite the fact that I smoke. I enjoy it from time to time. I don't want to wallow in it. BUT if a little bit of smoke, drifting from one yard to the next, happens to enter my house through an open window it's not that big of a deal. Your friend telling the neighbor to move would be no different than the neighbor telling yoru friend to shut up and shut the window which is the more appropriate response considering your friend is having the problem and not the neighbor.

My neighbors smoke used to always come in through the windows, it never bothered me, but my mother is allergic. she would just close the windows, which kinda sucked. they moved last week. i'll miss them. they were nice hippies.

My friend is actually the one smoking, and the neighbor is the one being an ass (IMO). She just moved into the place, and when she moved in the guy asked her if she would please smoke out back because the wind blows through the front window, which she did out of courtesy, and now the guy just sent her BOYFRIEND an email telling him that her smoke is invading his house. Her boyfriend (who doesn't smoke) is giving her shit about it now, too. I think she has the right to smoke wherever she wants on her own property and if the guy doesn't like it he can close the window. I was just wondering if others had the same opinion as well...

Well then, yes I do. I jsut thought the roles were reversed. Tell the neighbor e-mailing your concerns over isn't very neighborly and to stop being a fuckin' pansy.

It might make the nieghbor upset but there is nothing he can do about it.She can smoke all day if she wants to.The fact that her smoke blows into his house isn't her problem.

Nobody has the right to tell another person what to do on there own property, I know if it was my property I would say it's my property, I payed for it, I pay the taxes on it, it's a free country, get used to it.

You know and bitching and whinning over stuff like this never came about until the effects of second hand smoke crap started comming about, Whitch I believe is a bunch of crap.

    Exactly.

But your friend could also move a couple of feet away so that it doesn't bother her neighbors.... just show some cortesey and respect for human lives... Show the "anti-smoking fascists", as Birdy put it, that smokers also have a heart and are not prosmoking fascists who just have to blow smoke into everyone's faces.

The problem with that is she lives in a townhouse, so she only has the front or the back of the house to smoke without walking across someone else's property, or walking to the street. She thought she was being courteous by smoking out back like the guy wanted, but I guess it wasn't good enough.

I would just shut the window. Solves all problems without argument.
