SWIM wonders if someone who tells the cops that they may possibly have drugs in their house if they can legally search their house
i dont follow your question, but if your saying that if you tell the cops that theres drugs inside, are they allowed in... then i have no clue... why would you tell cops you have drugs inside?
as in someone told on them. Called the cops and ratted him out. Could they get like a search warrant or something
Of course - generally, the cops can get a search warrant for almost any reason with the excuse, "suspicious behaviour" or anything similar. But you can deny them entrance unless they actually have a search warrant. They can't hold you until they get a search warrant (some places they can for up to 2 hours, no more). You can refuse to even let a cop search your pockets (they can pat you down, nothing else) or car, purse, backpack, etc. without a search warrant. Once they have one, though, they'll use the fucking thing like an all-access pass. Also, in a lot of places, if you have a roommate and the cops come in to bust YOU, you don't have the authority to let the cops into their room. I read an article where a guy was busted for posession but it didn't go over because he was living with a roommate and the cops didn't have a warrant to search HIS personals, just the roommate's, and the weed was in his room in a dresser drawer, therefore "his" property, seperate from the roommate. Just a few extra random laws there. Good things to know, for sure.
this has no logic what so ever... when there is a warrant to search a premises.. that includes the whole lot... yard.. house... basement.. anything thats on that lot.. like a tool shed.. garage.. same goes with if you get pulled over in a car and they ask you to get out of the car so they can search.. if someone leaves their purse or jacket in the car.. its all searchable...
no its not, a warrant has to specify where they are searching and what they are searching for... a car is a whole nother story...
for instance, if you are pulled over by cops (cannot be for nothing, must have some reason, even if it is made up but believable, like a broken tail light, or drving strangely, etc.) and they smell something "suspicious," they can search your car (as far as I am aware), but this does not give them access to the trunk without a warrant, as it was not in the area of the "suspicion", its pretty complex
A car: Unless the cops have a specific reason to search your car, you can refuse them permission to do so (if you're the registered owner). If they see a gun on the floor. or a "green leafy substance" on a seat that's reason enough to search regardless of what you say. But keep in mind that cops lie. They can say you gave permission even if you didn't, who's the judge/jury gonna believe, a stoner or a cop? Your house: The cops need evidence to get a search warrant. Someone saying you have dope isn't enough evidence for a judge to issue a warrant. The warrant has to state what the cops are looking for. If they are looking for a stolen guitar, or a person for example, they cannot look in anything a guitar or person could not be, like a drawer. The cops CAN come in if they believe a person's safety is endangered, like hearing someone scream "help" or see smoke billowing out a window. And again, they can lie and claim they heard for example "the sound of a struggle".
Avoid wearing patchouli oil while driving. A pig used that as excuse to arrest me for DUI-D (driving under influence-drugs). Thing is that the only substance I had used that day was caffiene. This pig is the Chief Of Police in a certain town in MO where he is very well hated!
