i don't think so, however im not sure. about a year ago, my friend was selling his house, and it was one of the last weekends he was gonna be there. so he had a few people over, 5 people all together including him. he had a few drinks and listened to some music. after awhile we went upstairs and smoked a couple of bowls. we all got pretty baked, and after a cigarette, we all went back downstairs to play some pool. about 5 minutes into the game, we see this light over his fence and 2 cops walk into the back. they tell us people called and said there was a party and we were smoking pot and drinking. they talked to us for like 15 minutes, took down our info, and took a quick look around the room we were in. while this is going on, the one cops tell us that we all look high, and the cop points to me and says "esp. you." so i play it off and after they didnt smell anything or see anything, so they said to keep it down and left.

they obviously knew we were stoned, anyone could tell by looking at us (red eyes and all) they we smoked. however, we were in his house just minding our business and they couldn't find anything.

Yes, you absolutely can; intoxication can count as possession, especially if you're urine tested.

im sorry but your wrong intoxication cannot be counted as possesion, except in one state (cant remember which one). i got this from my drug counselor, whos been doing her job for years. so i am not wrong

remember she's in the UK man, not the US, the laws on that kinda shit may be different

but i don't see how you could get in shit for being baked without them finding paraphenelia (sp?) cuz without it they really don't have any proof, unless they test you
but i don't think they can just be like "you're stoned, we're taking you for a test"
they need probable cause if i'm not mistaken

Yes, you can. They cannot drug test you without your permission, but if you don't give your permission it's suspicion enough to arrest you. If you are caught driving while high you can be given a DUI.

So I can actually be arrested just for walking down the street with red eyes?

i was joking, they cant do shit to you for being high. im not sure if you walked up to a cop and actually admitted it. but if ur high, and cops think it and happen to search you to find nothing they cant do anything. possesion is a crime, not being stoned.

Public Intoxication is what gets you in trouble. As far as I could find, those cops that came to chiniseeyes' house couldn't charge him with anything.

    http://saumag.edu/adapt/adapt_brochure.pdf

From that: basically if you are impaired in public to the point that the police can say (probably a lot more likely if they think you're high) that you are a danger to either yourself or other people they can arrest you.
Another page said that in Texas a minor can be charged with possesion if they can be charged with public intoxication, but it didn't mention controlled drugs, just alcohol.
