So here's my story, I ended up getting arrested back in Novemeber on a possesion charge for pot and two OUI's one for drugs and alcohol. Anyways.... the judge wanted to dismiss the case, but the district attorney didn't want to let it go. So I ended up getting the possession charge a one year without a finding. My OUI's got dismissed, and I know i'm really lucky on that part. I heard the judge and my probation officer say that I would be randomly drug tested and alcohol tested for the first six months of probation. On the probation conditions sheet that I had to sing said that I would remain drug and alcohol free. On the other hand, where it says under other conditions: it says that screeings and counseling end on 6-13-07. Once that period was up I went back to smoking for a week and a half. Then I get a call about a job that was lined up for me that applied a month ago at my local hospital where they do pre-employment drug testing. So i've been clean since June 24th and I go in this afternoon at 1 p.m. to take my piss test. I've been testing myself and i've been reading negative. Once I get my results backI want to go back to smoking. But my parents said that the court can call me up anytime to take a drug test. I would like to know if the court is allowed to drug test after the scheduled drug testing period? During those first six months they never called me to drug test, or to check in with my probation officer. Do you think I will be safe to go back to smoking? Lastly, wouldn't the court be in violation if they drug tested me after the scheduled drug testing period? Please respond, and I would really appreciate if you guys have any insight or advice on this. P.S. i'll tell my busted story later in detail. Please help me out!!!
As long as you are on probation, the court can likely test you at their discression. This is ONLY my best guess. Good luck.
yea man probation and ur on it still? they can call u up ne time dont matter if they dont say how or when they r u r beening fucking let off once u complete ur probation totally worth not getting fucked n stop for a while
