He won the election in 2000. Maybe not the popular vote, but the electoral college vote, and the electoral college is all that matters. Doesn't matter if the whole us votes for one guy, if the electoral college votes for the other guy, the other guy wins. He DID win, but it proved that America isn't really a democracy.
There are a lot of old Supreme Court members ready to retire. Whoever is elected this November will likely appoint a couple of new members.
America is not a democracy, nor was it ever intended to be. It was set up to be a democratic republic. Frankly, the idea of majority rules on every issues scares the hell out of me, I think it's much easier to fight discrimination and infringements on civil rights the way our system is set up now.
Not to be humorless, but the Supreme Court actually ruled 7-2 in 2000 against holding a manual recount without uniform statewide standards in place. The 5-4 vote was on whether such standards could reasonably be crafted after the election.
