its sort of a grey area, but not so much as some substances.

papaver somniferum, the opium poppy, and just about every product made from it is a scheduled substance, making the unauthorized possession and manufacture/cultivation of it a criminal offense. that said, its one of the most commonly overlooked instances of criminal infractions in terms of drug offenses. it is a very common ornamental and culinary crop regardless. it is grown for its beautiful flowers, the attractive seedpods dried and used in arrangements and wreathes, and its seeds are the very poppy seeds found in many foods such as poppy seed muffins and bagels. there is a very large market for drug irrelevant poppy products.

however the poppy is illegal, and people can be and have been convicted of possession of or cultivation of poppies, even in small quantities.

what seems to make the difference is intent, while this is absent from many other crimes (in most instances courts take the attitude of either someone is guilty or innocent based on whether or not they actually broke the law, belittling the importance of whether or not someone intentionally broke the law.

a little old lady down the road growing poppies in her garden will not get busted. if you're a 20-something dropout in a bad neighborhood living in a house with 6 other people your age and you grow poppies and nothing but poppies in the flower beds around your house and neighbors see you spending lots of time scraping at the seedpods with a knife, you're far more likely to get arrested.

and it doesnt have to be anywhere that drastic. while instances of charges of drug crime involving poppies are the VAST minority of any instances of people possessing poppies, they do happen and it seems only to people guilty of the crime. i've read a number of articles reporting about folks who got caught ordering boxes and boxes of poppy pods online, folks who grew and harvested their own opium, and college students who had it in their dorm rooms.

you can grow it if there is absolutely no evidence that you intend to use it for drug related purposes.

It's Funny this Spring I was walking by The Woodstock Green which is our Village Square and there in the Garden was The Famous Poppy Growing! Someone had no idea they had planted them along with all the other flowers. When they reached mature....They were gone only leaving a lot of holes where they once stood.
Who EVER harvested them REALLY ENJOYED a FREE RUSH! Wink
I HEAR they make GREAT TEA! Rock ON! The Wiz
