They barely scrape by just because cops turn the blind eye most of the time. Head shops do get busted fairly often though, kids always going to buy a pipe and their parents bitching to some congress about a store selling drug paraphernalia to kids, then it gets raided and no more headies.

Because courts have ruled that the government can't outlaw the sale of devices that can be used for legal purposes such as smoking tobacco and other herbs. Yes, it's stupid. Yes, it's hypocritical. So is the fact that there are speed limits that aren't enforced... so is the fact that alcohol is legal while weed is not. So are things like the Patriot Act. Welcome to reality.
that was along ass time ago bro. Anywho they get away with it because sometimes there are actually legit buyers who want tobacco.
All I know is there are 4 headshops within a 20 min drive of me and at every one of them there is a big noticeable sign on the wall that says "Please do not make any references to illegal substances while buying a pipe from us or we cant sell it to you." Also theres something in the law that states they cant use the term bong or bowl because its too closely associated to marijuana use. You have to use the terms water pipe and pipe. They usually also have a sign that says "If your not sure of the name of what you want just point to it." It pretty much is just a cover your ass measure to keep the store legit. Although there is a somewhat conservative village near me. Lots of very old people and families with young children. There was a gas station in the village that started selling glass pipes and the people flipped out. They went to the local authorities and when they found out they couldnt do anything about it they just boycotted the store and noone bought gas from them or shopped there. It was kinda sad, but 3 months later the store went out of business.
