In-School Searches

So there's no confusion, I'm 14 years old, a freshman in high school in Ohio, with a 3.6 GPA, and use herb to expand the way I think about the world. I'm not some kid who just likes being fucked up.

I've never been searched in school, but several of my friends have been. So apparently when you get searched, a Vice Principal comes to your class, asks you to bring all your stuff and come out into the hall. They proceed to take you to the office.

The VP then takes your backpack, unzips everything, dumps everything out, and goes through all the pockets to make sure nothing is hidden. They then ask you to empty your pockets.

My question is regarding the laws on personal searches in school. Do they legally have the right to take your backpack and search it? Do they have the right to force you to empty your pockets? Or would I be within my legal rights to REFUSE a search. What can they do besides contact my parents and say I'm refusing a search?

you are a juvenile in a public school,,you have no rights..

plain and simple..

can they search your belongings,your locker etc? yes.

can you refuse them searching your person? sure but your parents will be summoned etc..

 

yeah basically you got no rights during school time since they are the authorities that will watch you everyday between 7-2 or w/e =/

In college its a little easier..they just go through the parking lot with a k9

 

So what happens if I get called out of class for a search, and refuse to let them take my backpack? And if they try and take it from me forcefully, what happens if I just run?

youll go to juvey more than likely,,at the very least youll be suspended if not expelled..

once again,, YOU HAVE NO RIGHTS...

 

they grab you. you're theirs. they have the right to search anything and everything you bring to school.

okay you run and go home and everything is happy, then they call your parents and say when they asked you about what you had in your bag you ran away? then they know you're hiding something, then you go back the next day and get suspended or expelled just dont bring it to school dude

 

Yeah the staff at a public school pretty much has the same rights as your parents do during the school day. You are a minor on someone elses property. Bringing illegal things to a school in this day and age isnt that smart of an idea.

 

yeah one day this chick in my class loses her wallet 3 minutes before the bell rings and all the security from my school walks in the class and they say theyre gonna search everyones backpacks and pockets... but then all the sudden i remember that I have a 750k volt taser in my backpack that I forgot to take out when I had it in my backpack over the weekend, and I also had about a gram of weed and a swisher... so I stash that shit in a hidden place in the classroom when no one was looking my way (which was actually pretty hard) and got it back from the same spot the next day. they didnt find shit . (except a bottle of robitusson max strength that was in my backpack but they just took it and kept it with the nurse.)

 

if you refused that would make you look guilty as hell
solution: dont put weed in your backpack or pockets

 

do not bring it to school...there is no reason at all...

 

fuck. I know how you feel. You don't seem like a dumb kid (even tho 14 is a bit young, but I'd be a hypocrite to say that you shouldn't be smoking) so just be careful. The easy thing to say is don't bring weed to school, but sometimes thats the only way to make a deal. At my school they have drug dogs, so the only thing to do is bring it during the beginning of the school year, the end or a few days after the dogs have came.

As for searches, there should be no reason to search you unless you did some thing wrong, right? Sadly thats not true so be careful, avoid buying weed at school, and don't be suspicious.

 

Luckily the only time my school does seaches is when someone accuses something of stealing something. They can search your car but who would leave their weed in the car when at school.

 

They have that at my school too.. but half ass. They just take dogs up and down the halls once a year to sniff out the lockers. None have ever come into the classroom. I'd say if you're doing a deal or something just tape it to your leg.. otherwise don't bring it.

 

Lots of people, it's better than having it in school..

 

When i got searched they went through everything in my locker, i had to take my shoes off, clap them, pull my shirt up and spin around (making sure nothing was hidden between my waist and pants) and pull my pockets out, pull my pant legs up. Yeah, its bullshit.

 

yes they do, it is known as "in loco parentis." basically means that because you are minor, and you are placed in the care of a teacher or an administrator they take on the roles and responsibilities of a parent.

 

you legally have to go to school, but they shit all over your legal rights when you do...

Just don't bring weed to school.
