I just had quite a shitty conversation with my friend. Person "S", called up my friend last night (Friday) and they agreed on meeting up. Person "D" never showed up, and didn't answer any calls for the rest of the night, or today either I guess. Well, he finally called back and he spent the night in jail last night. On his way driving to my neighborhood (less than 2 miles away) he got pulled over for his left brakelight being out. The policeman smelled contraband, which came from alot of his Cannabis products, and he was charged with a DUI. He is 19 years old, and says he has to pay a 6000 fine now, and may have his liscence taken away. On top of that, he got his Medical Marijuana card a few weeks ago (I live in California). I don't know if he can get this charge thrown out because of the fact that he was driving with canisters that had been opened. He got a lawyer off of the NORML website, but I was wondering if anybody has any other advice or experience with this kind of situation.
if he has a medial card then how can they charge u with dui when he "needs" it sry i dont know how it works i dont live in callafornia
Yeah, well since recently cops pretty much don't give a fuck about medical cards. Alot of the marijuana patients I know have gotten Possesion tickets; they get them thrown out in court, but I guess the cops feel satisfied knowing they still fucked somebody over. I mean it's pretty ridiculous, I doubt he would have smoked alone before he left his house to come chill with us so he wasn't even Driving Under the Influence.
i believe ,if the laws written like a lot of script drugs such as oxys etc. he can be charged for driving baked even with a card. a lot of prescriptions your not supposed to drive on,an ya can get a dui for that reason.. on a related note,i just read where the supreme court of cali ordered a police department to return a doods weed confiscated in a traffic stop..
Yes, I was thinking the same thing but I assume he wasn't actually intoxicated at all when he was driving, he was just in posession of the herb while he was driving. Would you be penalized if you had your perscription bottle in your vehicle but were not intoxicated? I realize that there is no way to tell unless it is obvious that the person is totally wrecked or trashed or whathaveyou. It is quite a bum situation; there was not even enough cannabis in the car to have justified a possesion ticket if he wasn't a patient (it wouldn't have even weighed out to a 1/4 oz of bud that he was bringing). Penalties for a DUI are much more severe than possession. Like I said he got a lawyer from NORML, all I can do is show some support and hope that he doesn't get fucked over too bad.
