Anyone know the minimum sentence for trafficking..?

    Hey whats up? Earlier today a friend of mine's home got raided. They found 1 lb of dried mushrooms, 200 e pills, 2 viles of LSD (about 120 hits in each one), and maybe 2 lbs of weed.


    This happened in NY, so I know the laws are different in different states.

    I'm just curious because I've been thinking about it all day, and the internet is pretty useless so far. Telling me what one would face for selling say 800 pills, a gram of LSD, or 60,000 lbs of mushrooms.


    What do you guys think??

    Your friend is looking at time unless he rats out a higher up, but, then, he's looking at getting killed. Its hard to tell because there are so many variables from state to state, county to county, and person to person. But, if this is the stuff he got rolled with, he is looking at time.

    The best advice for him is to scrape together every dime he has (sell the house and car, seriously) and get a very good lawyer with a proven record of getting people off.

    In the end he'll be locked up for 5-10 years. A mix of a good lawyer, good behavior, time served, etc...

    It all adds up to 5-10 years actual time behind bars. I hope this wasn't your boyfriend.

    It sounds like NY is extremely harsh in sentencing. Your friend had quite a bit of stuff it sounds like, more than it could be believed for just personal use.

    It also sounds like he will get charged both for sale and possesion, depending on how long he's been setup for.

    NY seems to have mandatory minimums, so if he's convicted with those charges, I would say he's looking at a sentance 10+ years in prison minimum. As has been said before the actual time served can vary a lot.
    Of course, if he's a first time offender, has a job, is young, they may allow him to plea down to lesser charges such as simple possession, but again, with that much stuff it doesn't look good.

    On the plus side, it wasn't coke or heroin. I'm not sure how informed NY is of E, but some places treat it the same as meth because "methamphetamine" is in the name, and that brings harsher sentancing than a party drug.

    As you can see, there are a lot of variables here, but the bottom line is that unless your friend rats out some higher-ups, he's probably going away for a good portion of time. When he finds out exactly what he's been charged with, and released (providing he makes bail) you can find out exactly what the minimums are. Tough situation, I feel very sorry for your friend.

    I also found out what charges he's facing.

    One class A felony, 4 class B felonies, 1 class C felony, 1 class D felony, 1 class E felony, and 1 class A misdemeanor.

    My guess is also 10+ years, especially the fact that in NY state when you get caught selling ecstacy it goes in as attempted manslaughter.

    LOL. No chance that's true. Funny rumor though. Regardless, with a $5,000 - $10,000 lawyer, he'll do 5-10 years.

    Truth is, he's fucked.

    In my opinion, dealing that much is just plain moronic, unless you're financially set for life.

    Because fun and games aren't worth sacrificing your virgin ass for.

    you beat me too it, i hate that rumor....a class a felony is pretty severe but i dont understand how it is a class a felony...i have the penal law in front of me and the only thing that can give you a class a felony is sale of a shitload methadone or a lot of a "dangerouse depprsant" aka opiate...i think u have that wrong...theres no way its a class A felony unless he had i think 8oz of heroin or 560 10mg methadone's...
