so i live in a college town and i was riding my bike in the middle of the night to this chick's house in the middle of the night, and i had beer on my breath and about a gram of reefer in my pocket... next thing i know i see the lights so i pull over and the cops ask me why i have a flashlight.. I said that i thought it was illegal to ride a bike without a light after dark... so the officer informs me that someone's been breaking in to houses along a road that i happened to have been on for 0.2 miles. they ask me how much i had to drink and i said a couple beers... they breathalyze me and next thing i know they're patting me down and i tell them that i didnt consent to a search, to which they replied "you're already under arrest for the underage". they find like a .4 nug and a couple of roaches. they took it, got my address, and told me that i'd be getting my citations in the mail. they told me to walk my bike the rest of the way otherwise they'd give me a DUI too... so in PA, second offense underage is a year suspention on my licence and somewhere around a 500 dollar fine. Posession of less than 30 grams is punishable by upto 30 days in prison and a 500 dollar fine. does anyone have any insight? anyone here with any similar experiences? i just turned 18 in may...
Once I was nearly arrested for smoking marijuana in a cemetary after dark. I was sitting where my parents had a plot - they were still alive at the time - when "something" told me not to leave the same way I walked in. When I walked past the main entrance a police car was waiting for me. I must have set off an electronic eye device. I was as they say, "dirty." I had a marijuana pipe and perhaps 1/8 of an ounce of weed. Possession of marijuana and trespassing in a cemetary after closing hours are offenses I am glad I never had to explain on a job application. More recently I was detained for DUI on a bicycle. A lawyer got it reduced to public intoxication. You should never drive a car or ride a bicycle after drinking. Walk home, take public transportation, or call a taxi. I haven't smoked marijuana for over two decades, but when I was young I took chances I should not have. Once I visited a friend in Pelham, NY right after New York Governor Nelson Rockefeller signed some draconian anti-marijuana laws. My friend and I spent my visit stoned to the gills. That was really foolish and dangerous.
Can you really get a DUI for biking? That's total bullshit...you won't hurt anyone but yourself whereas in a car if you crash into another car it may hurt the people in the car. On a bike you hit a car and you go flying. Good luck though man,i hope they don't nail ya with anything too harsh.
You shouldn't have accepted to take a breathalyzer test, you could have gotten out of it all if you would have rejected one. But you had weed on you so you should have just ran. I fuckin hate cops, this guy sounds like a prick.
If you refuse a breathalizer its an admission of guilt so basically instead of going before a judge and saying guilty or not guilty you forfitt your rights and he would have almost for sure been issued a dui
Sorry but you're very wrong on this one. If you refuse a dui it makes their case hard to prove because they have no evidence besides the cops opinion unless you acted like an ass in the police video. They can take your liscense for three months for refusing a breath test, but it doesnt show up as a dui on record. However, if you agree to take a breath test and fail, you are guaranteed a dui and you just handed the cops the evidence they need to convict you. Know thy rights.
I know a few kids in their mid 20s with them...they were all of legal age at the time. We call them BUI's...bui is a serious offense and the dangers of riding a bike drunk are not just to protect otheres but to protect yourself. imagine you are riding down the sidewalk, swerve and fall in the street only because you are shithoused and then BAM! you get hit by a car. You're dead and have fucked with someelse's conscience for life.
In the state of North Carolina, if you refuse a sobriety test your license is suspended for 1 year no questions asked. It will land you in some deep shit. The trade would probably never be worth it unless you want to ride around a <50cc moped for a year. I would say that you are partially correct sir. But you must admit, it would be hard to make an informed decision like that with any kind of speed in the middle of such a situation.
I work for the DMV and come across several out of state licenses that have printed on the back "Failure to consent to a sobriety test is an admission of guilt and will result in the revocation or suspension of your license" It varies in every state.
Cops in PA suck, especially ones in my college down. I got an underage and 2 disorderly conducts from them bastards. My underage and one disorderly I got away with, but I just paid the fine for my other disorderly just recently. Cops came to my house saying they could smell weed smoke from the alley where my house is. They came in, and made me give them all my weed stuff (weed, papers, pipe, etc) After that he said he could get me year and a half probation and all that, but ended up just getting a disorderly conduct.
well my first underage was before i turned 18 so i dont think that this one will count as the second underage, and since this is my first offence for possession, i might be able to get probation, which will clear the offence off of my record... so pretty much im just looking at a fine and 9 months without a licence, if all goes well. think good thoughts for me plz
refusing to take a sobriety test is the same as admitting to being drunk, and in most cases, carries heavier penalties.
so what should i expect from probation? i havent smoked since before i got busted, and im not going to risk putting ANYTHING into my body if im going to be getting piss tested... but anyone got any estimates of how long i'll be probated for?
I got 90/96 in nc today. It's a year probation for drug related and 90 days for alcohol related.<<< That's fucked up. Plus I have to go to narcotics anonymous classes. Random drug tests too. Damn. You should be okay though I guess. Dont know if your parentals are involved but mine I managed to keep in the dark. Im thinking smooth sailing.
i ride my bike up the street to my friends house usually late at night and if any cars come by I usually get off my bike and walk. And if any car looks like a cop car im usually off my bike hidin. Did the cops just pop out of nowhere?
yeah.. i got my papers today, im getting posession (upto 500 dollar fine, upto a month in jail), posession of paraphenalia (upto 2500 dollar fine, upto a year in jail)... they counted the roaches as paraphenalia... i'm getting a lawyer, but i dont know if i should pay for one. I pretty much self-incriminated the god damned fuck out of myself, its all on tape and there were like 6 cops to verify what i did and said.. I've quit doing everything, I should be clean by the first piss test... i gotta get fingerprinted within 5 days.
