I know this applies to search warrants. If a search warrant is issued it must specifically state what they are looking for and where they are going to look. Letting the cops in was a bad move but what if the shooting suspect had somehow made it into your house? If the marijuana they found can be used to press charges, I'm sure a good lawyer could work out a very good deal. Hopefully your friend will find a lawyer experienced in criminal drug cases that can prove there were not 80 plants. The difference between 10 and 80 plants in some states can be more than an extra decade you could spend in prison.
Your friend is an idiot, no offense. Everyone knows that cops will try to get the biggest penalty on you so its not like its weird for them to count 10 plants as 80. Your friend should have never even opened the door. Anyone who keeps anything illegal in their house needs to know what to do if the cops come knocking, especially with the amount he had. If your just going to let the police in your home without putting up a little resistance then you have little room to complain.
i dont think they can, they need to get a warrent inorder to search and seize(sp) they had a verbal agreement for a shooting suspect not a marijuana grow op. they need to go to a judge and get a warrent so this case may be thrown out
Reasonable suspicion. They could smell the pot. He should have said no you can't come in locked the door and walk out of the house and called a lawyer.
I would of acted like no one was home. Fuck letting the police inside your house when you have 10 pounds of fresh bud.
while i agree with you that some cops can me assholes and abuse their power almost the the extent that it can only be described as tyrannical. there are still many cops, whom i would call the silent majority, they are mainly good people trying to protect the community and i believe that, at least i want to. Anywho i think it's just the 10% of cops that are assholes who ruin it for them all
He said he'll call me back Cops always overestimate how much they recover, they'll find a gram and say the street value was $5 billion =/
still impresses me. that's a lot of bud. i'm sure he shared a lot with friends. anyways, good luck to him.
