Busted at College

    Hey,

    I got busted at school and got charged with possession of marijuana (about 6 grams) and possession of paraphernalia. I am first time offender with no criminal record.

    Originally, I thought the case was going to municipal court, but I just found out that I am going to superior court (state court).

    I had a few questions:

    1) Are the penalties going to be harsher because the case is going to state court?

    2) What do you guys think the penalties will be (fines, community service, any jail time, etc.)

    I know this is just a forum and a lawyer would be better suited to answer these questions, but I am just looking for some answers and help.

    if you're in the uk you are prob looking at 4 years with unlimited fine.

    First offenses are usually a slap on the wrist. You may end up with some fines, community service, or probation but it is highly unlikely you will serve any time. You may want to get a lawyer (doesn't have to be expensive) to see if there are any options such as outpatient rehab that could keep this offense off your record.

    I would be more concerned with your school's policy. You may be facing some sort of academic probation.

    I already straightened everything out with school.

    I am just worried about what penalties I am going to face by the court.

    Anyone else have any ideas on the penalties?

    Also, will the judge ask me if I had smoked in the past?

    Don't have any green on you for a while... Now they're liable to watch you like hawks for a good while.

    yea...they're probably going to watch me like hawks and no more screws up like this any more...

    For anyone who has gone through a similar process or knows about stuff like this (or for anyone who has any ideas or input):

    What kind of questions will the judge/court ask me?...Will the judge/court ask me if I had smoked in the past?...

    WTF are you talking about?

    Get caught with 6 grams in the UK and they write you a little receipt, search you and confiscate the pot, there's not even a fine, let alone 4 years incarceration.. If you're caught repeatedly and persist you may have a written caution or a small fine but you don't get arrested for posession if you're over 18..

    Do you know how many people are arrested each year for possession? I wouldn't smoke until court just so you can piss clean for the judge but don't get all paranoid.

    does anyone know what the penalties are for the pre-trial intervention...like how long the probation is for and how much are the total fines...

    Also, is part of the pre-trial intervention drug testing or is that up to the judge...like is their a possibility that drug testing may not be part of the program...

    Also, do you guys think the the judge will take away my drivers licence...

    I am from NJ and above 18 and have no past record

    so i guess no one knows about the pre-trial intervention....

    I had another question...Will the court check my school record, such as my grades? (i guess to prove that i am a good student)

    I don't think the court even has the right to check your grades. You may be asked about your grades and if you are doing well I would play that card to the fullest extent.
