Recently I was busted by our good old friendly law enforcement officer, and received 2 tickets; possession of THC and possession of paraphenalia. However I was wondering if I can be charged with the possession of THC because we had no pot left when we got busted. The officer said I was in possession of it in my system and this was enough to get the ticket. I received the ticket in La Crosse, Wisconsin but I was under the impression i couldn't get a possession ticket unless I had the pot. I accept the paraphenalia ticket. I will be going to fight the possession ticket regardless because we were cooperative with the cop and he wrote it in the report but does anyone know if having pot in your system constitutes getting a possession ticket. I am also wondering if since this ticket happened in wisconsin and i'm heading home for winter break to minnesota, will any ticket i get affect my penalties in wisconsin.
I have heard of people getting possession charges for being under the influence of marijuana. Is this your first offense? If so I wouldn't be too worried about the possession. I can't speak for your state but in my state the paraphenalia charges are much worse than simple possession. While possession is a fine you can do up to 30 days for paraphenalia.
wisconsin is hard on both, but with the possession of THC your second offense is considered a felony. But this was my first charge.
Ask NORML or something. Or better yet, why dont you ask one of those people whos job it is to know the laws in your area....a lawyer.
Surely Possession and Influence are two different charges? I'm in the UK so I can't comment on American law.
They are going to charge you with whatever they can. Be happy they only charged you with the first two. If you want to fight it I would suggest you talk to a lawyer first. He will tell you to pay the ticket, or he will want money and then you will have to pay him and the ticket.
the fact is he said i got possession for what was in my system, not in the pipe. Therefore the charge was for what was in my system and if that's not reason for a ticket then it should get dropped.
This may be a dumb question by me, but does the cop have proof you had it in your system? If he just "thinks" you had some in your system, you should be able to win that, but I don't know what happened there so I had to ask...
