Hi.. I need a little information but heres my story. I was up my road riding my bike and a few friends stopped. They had a little bit of shake and i had my pipe. i let them use my pipe but i did not smoke any. i was getting ready to leave and.... The cops pulled up. 2 cars and 1 car had a dog in it. they told us to leave our hands out of our pockets. then they told us to put our hands against the car and asked if we had any drugs on us. we all told them no. then when he was going to search the car i said i have a pipe in my pocket here. so i gave it to them. one of my friends told them that she had a bong in the trunk. so they found that. they found bags with nothing in it. so they got our names and numbers thenthey called parents and they came. What will happen to me?. they only found a pipe. Will i go to court? they said i might not have to. Please inform me. Thanks.
http://norml.org/index.cfm?Group_ID=4557 Ohio has pretty liberal laws but paraphernalia is still a misdemeanor. You could receive a court summons in the mail but if the cops didn't mention anything you might be ok. You'll have to wait it out but some members here have received court summons months after their run in with the law.
Never consent to a search unless you are caught red-handed. Then, if they go ahead and search you against your will, anything they find on you cant be brought as evidence against you in a court of law.
Exactly what Drew said... Around my area the cops always threaten to arrest you or get a warrent if you don't consent to searches for stupid things like walking through a park at night... I never give in and just let them know that I know my rights. They never end up arresting me or anything, they just act like dicks (like most cops I encounter in my area) and take my name and information down.... So yes, never consent to a search unless it's neccessary.
You'd have to assume that if two cops showed up right as they finished smoking that they knew what was up.
So, do you think i will have to go to court? Someone i know said i'll probably just get fined and thats it.
HA HAAAAAAAAAA! Small world. I pass through there on occasion. Sucks what happened dude. Don't consent to the search, and they had no right to search you. Period. Also, don't cave in when they pull the "You got any drugs?" shit... Who the hell busted you?
The cops busted me. They got a call and someone said we were passing something around. Its been a little more than a week and nothing has happened yet. Hopefully nothing does.....
Well guys, i havnt heard any news from them so i guess im safe, hopefully. Ive been taking my chances though. Cant get enough of that Wonderful Cannabis. It has to be one of the best drugs ever. It can be used for like everything. They should LEGALIZE IT!!!! Probably wont happen but if i was president i would legalize it most likley. =) haha
heres what could happen. I was arrested July 29, 2008. They found a pipe on me, took me to the station, and had my mom pick me up. They took down all my information and everything. I didn't hear anything about it for two months, when I got a paper saying I needed to appear at the judicial office 10/5/08. When I got there, they said I could accept my charges, and go to the magistrate and get my punishment. I could not accept my punishment, get a lawyer, and take it to court. or seeing as how I was a first time offender and a minor, they said I could join the first time offenders program. I had to do random piss tests (they only took one that day and one when I got off) I had to write an essay, and I have to take Drug and Alcohol Treatment. I came back in a month, they made me take a piss test, which I passed. I handed in my essay, and they said I was done with the program, but I have to finish Drug and Alcohol Treatment. I get off that 2/4/09. so yeah, there is still a chance you'll be prosecuted.
they didnt take me anywhere they just asked my name and phone number and let me go its been about 2 months or longer
Same shit happend to me, they gave you a "verbal warning". They just took all our information, called our parents, and we went home. I miss the ounce I had to dispose of though
