If you're convicted, and sentenced to say, 40 years in prison, and after you get out, you find out that, through some bizarre occurence, the dude you spent 40 years in jail for killing, isn't dead... you can kill him, and not get in trouble for it.
hmmm... i wonde rif you can still get arrested for trying to hurt or rape the person.... what if that person kills you? this must really hurt lawyers heads... i bet that you could still get arrested for killing the person though, all they would have to do is prove that the first case was void
If the first cse was void, you've already served the time for it, so they would have to compensate you for it... and that compensation would take the form of not putting you in jail again.
Yes you're allowed to kill that person without penality... but why would you? I would rather capture him and bring him to a police station so I can claim that I did not in fact kill him and get a HUUUUUUGE cash settlement
double jeopardy doesnt exist if the crime never took place. therefore you cannot kill him and get away with it. but if this really happened, and you spent the better part of your life in jail ( and i say that in context, cause with all that money, i'll bet you'll enjoy yourself much more after it was all over) all you could do was sue sue sue. but, its hard to convict a murder without a body, or a witness to the murder, or some explination of where the corpse went. It could happen, but its not likely to happen that often.
double jeapordy is a messed up concept. the fact that the goverment allows you to kill someone under those conditions is very messed up
Hows it messed up? The point is you already served the time for doing it, so you might is well actualy do it.
alright, i did some research. apparently double jeapordy is infact not true. you can still be convicted of the killing the second time. the movie was just using a word play. the only thing is if no one finds out that the person was actually alive then its probly easier to kill them
Crime A = Person X being Killed. Crime B = Person X being Killed. Sure sounds like the same crime to me. (OK, I admit to knowing nothing about the law, and for all I know, you could be correct, I just think that it's unfair to be tried for the same crime twice.... or we're going to start picking random people in jail and convicting them for a second time.... just for the fun of it).
