Plead guilty or not guilty? That is the question

Ok, so about last week I got my first possession charge. I was offically charged with possession of marijuana, now, I have my court day for this about a week from now so I'm still thinking about whether to plead guilty or not guilty to this charge. My parents might be calling up our family attorney to fight this case, we're not sure yet. Because here's how the whole thing went down. So I was at this big party pretty much, whole bunch of people, loud music, u know the deal. So anyways, I guess some neighbor called and made some kind of noise complaint or something, so the cops come over and ask us to turn the music down. So, now here's where things get interesting, one of the cops says, "Something smells like pot". So apparently they argued that this gave them probable cause to look through the house, which I think is bullshit, but we'll leave that to the judge to decide. Anyways, so this part is pretty funny, when the cops show up, I'm in the bathroom taking a shit. And here's what sucked about being in the bathroom, apparently, in the bathroom sink- some fool left some bud laying in the sink- probably enough to pack 4 bowls with, so, next thing I know. The cop is knocking on the door where I'm shitting saying "This is the police, open up." So, I get done doing my business, and walk outside and the cops go in the bathroom and find all of this weed in the sink- next thing I know, I'm getting cuffed by an officer with him saying "You are being arrested for possession of marijuana, you have the right to remain silent, anything you say can and will be used against you in a court of law.... blah blah blah" And the thing is is that my weed was actually in my jacket pocket, and my jacket was in my car, and I don't even think the cops even looked through my car, I guess they assumed that the weed they found in the bathroom sink was mine since I was the last one in the bathroom.

So, now this leaves me with 3 options, either A.) plead not guilty, get a lawyer, and try and fight this bullshit charge

B.) plead guilty and just pay the consequences

C.) plead no contest and just see how everything plays out.

 

Get a lawyer and let him tell you what to do

 

Just get a lawyer bro. Ask the lawyer that you would prefer he do something in court that would help you not get that shit in your record. Once that shits on your record, you"ll find yourself with a lot of closed doors for like great job oppurtunities. Good luck.

 

You are in one hell of a shitty situation. You will be found guilty but they may give you a plea bargain.

The Supreme Court established probable cause to include smell so they had every right to search. I'm also going to assume there were underage drinkers which is another reason they could have entered.

How could you be in a bathroom and not notice weed in the sink? When the cops entered the house and found you in the bathroom they probably thought you were getting rid of evidence. I don't know if this is the proper term but I've heard cops say "constructive possession" when something is found within your reach.

Get a lawyer as they have a solid case.

 

Well, it is always smart to get a lawyer and shut up when they tell you. That sucks, been there. You could even add a bit more humility to the story you just told and tell the judge that. You had some, you were taking a dump in what clearly became a public toilet.

4 bowls, not sure what size, so a good joint or two small ones, if you are not a criminal, I do not beleive you will be spending the night there. Good Luck
