im not disputing that. do you know of anyone under 65 who has used that and not been ticketed?? oh and to the OP, dilli is native to new york and says unless things have changed it doesnt matter if its a trout stream or not. there are a couple exceptions but most waterways if they adjoin your property you do not need a license.

ok thanks its kinda far from my house so im hoping not to have to go to court. i think im just gonna mail in my ticket and plea not guilty with a note saying i was on my property and see how that works out.
If you honestly think that's the case, fight it in court. But I'm telling you, knowing the canal system through Wayne and Monroe as I do, you don't own the water or the bed through which it flows. Doesn't matter where you live, it's all Empire property, pun totally intended.

a canal is different,it has corp lines even if it on your property but generally with creeks and rivers the property line goes to the middle of the stream,unless of course you own both sides of the waterway. i dunno,id fight it personally,at the very least i would consult a lawyer. something like this you should be able to find one to clarify the law for you for free over the phone.
As stated previously by both the cop and another poster, you don't own the water. It's not your property. It's not even your dad's property. You broke the law and got caught. Quit the bitchin.
You would be surprised just how little protection of your rights to privacy and unreasonable search and seizure you actually have on private property. You have protection within your curtilage, the area right around your home, but a law enforcement official can legally trespass on private property while "in the line of duty" even if it is posted No Trespassing. A LEO can also drive into your driveway and come and knock on your door while doing his job unless you have a gate. He may be just looking for someone else and had the wrong house, but if he were to see say some weed he could bust you. I'm sure these laws vary by state and my familiarity of these laws relates to AK and CA. So the fish cop was looking for illegal fishers, in the line of duty, and therefore probably was within the law even on you property.
this is how i've always understood the law. even if you live on a lake, i was under the impression that you owned so many feet from the shore.. even so, i feel like siding with the cop because he was accused of stealing beer which he legally confiscated from a minor, as per his job description...
