I just had a pair of cops pull me over, test me for drugs (which I don't use) and force me to answer a whole load of probing and personal questions for about 10 minutes during which they talked to me like I was no better than shit. I suppose there are far worse things that police can do to people but I still feel kind of violated.
Holy fuck, they can legally drug test you just pulling you over? I am so fucking glad I live in America now.
I am not really sure on the laws in Australia, but I question their authority to "test" you for drugs without probable cause. Also, you were under no obligation to answer their questions and should have refused.
Australia has some fucked up laws. Some Aussie on LiveLeak was arrested for posting a video of some gypsy circus performer swinging a baby, even though that video was taken from YouTube and can be seen on various sites on the internet. The mainstream media here in the states even aired footage from it.
Something tells me that Australia has even more dumb people per capita than the US, which forces them to have stricter laws.
You're right. Free Speech is not guaranteed in our constitution so sometimes our handle on issues like the one you mentioned are questionable. Police here are normally quite good though, very ethical and easy to talk to. I just don't know what my rights are though. I saw police in England almost brutalize someone for just trying to reason with them, I didn't want to cause more trouble with the police today just because I felt like "speaking out", they would have found something to do me in for not in the least my bald front tires. I suppose that is why I am pissed off, they were in a position to treat me like shit and I was powerless to defend myself. Police are legally allowed to pull people over here for "random" breath tests. It happens to me a lot, probably because I am young, have an old car and have a messy appearance.
That is possible. I tend to drive pretty carelessly when there is no traffic around me, whereas most normal people stay within the lines at all times.
But how do you know it's lawful for them to randomly pull people over and drug test them if you, as you stated, don't know your rights? Just saying.
Its common knowledge. Its been on the news. They've advertised it on TV. Its basically just their way of trying to crack down on drunk drivers. What I don't know is to what extent it was legal for those police to hold me there and question me for no apparent reason and to what extent I was able to refuse. At the end of the day I probably did the right thing because they would have found something to charge me for otherwise. A good policeman is one that doesn't abuse that position of power.
Talk with ChaosFactor. We just had a similar thread. I've been stopped like this on foot but not for drug testing. They were basically on a fishing expedition to find anything they could but didn't. I shouldn't have bothered talking with them since they weren't detaining me and couldn't since there was no probable cause. The only useful thing was watching the cop fall apart emotionally when he realized he was wrong about everything. .
