California Civil Code Section 1941.1 and breaking our lease

I am thinkign of talkign my husband into breaking our lease. We got a VERY cute house. So cute, the peopel in our town say 'oh you guys are the people who are renting the cute house?'.
BUT and this is a huge but, the water is GROSS. It smells. I can;t do laundry, it ruined a load of towels and blanket in my favorite fabric that I made for my dogs.
Also, the gas man said the hot water heater could not be turned on because there isn;t enough ventalation. 2 days later and the landlords have still not cut the hole out for the ventalation.
When we moved in, the landlords provided us with a fridge. It was so gross, we moved it out side and bought a new fridge. I had an asthma attack fromt he mold in teh ladnlords fridge.
The house looks so perfect, all wood floors, huge lot, huge brick fireplace, brand new kitchen, ceramic cook-top. I mean just so gorgeous, but what good is that if I can't do laundry or it smells when I take a shower.

I emailed the landlords with the concerns about the water and am gettign my ducks in a row for documentation.
I just don't know what to do.
I know the laundry room was built without a permit, so that alone could legally allow us to break the lease, but how much of a hassle is this really going to be? Should we tough it out for a year until the lease is up?

 

On top of it all, the Navy called me 5 days after we signed the lease to say base housing was availible. Base housing= 300 more square feet and none of these problems and no deposit and huge amounts of money we have paid to make this place habitable and make up for the lack of space.
I am just at a loss of what to do. I did not renew my medical marijuana perscription either, so I can't get stoned otu of my goard before I take stinky showers.

 

how come the Navy dont have any House Boats? that is kinda odd..

 

Have you considered a water filtration system and softener?

What is civil code section 1941.1?

 

1941.1. A dwelling shall be deemed untenantable for purposes of
Section 1941 if it substantially lacks any of the following
affirmative standard characteristics or is a residential unit
described in Section 17920.3 or 17920.10 of the Health and Safety
Code:
(a) Effective waterproofing and weather protection of roof and
exterior walls, including unbroken windows and doors.
(b) Plumbing or gas facilities that conformed to applicable law in
effect at the time of installation, maintained in good working
order.
(c) A water supply approved under applicable law that is under the
control of the tenant, capable of producing hot and cold running
water, or a system that is under the control of the landlord, that
produces hot and cold running water, furnished to appropriate
fixtures, and connected to a sewage disposal system approved under
applicable law.
(d) Heating facilities that conformed with applicable law at the
time of installation, maintained in good working order.
(e) Electrical lighting, with wiring and electrical equipment that
conformed with applicable law at the time of installation,
maintained in good working order.
(f) Building, grounds, and appurtenances at the time of the
commencement of the lease or rental agreement, and all areas under
control of the landlord, kept in every part clean, sanitary, and free
from all accumulations of debris, filth, rubbish, garbage, rodents,
and vermin.
(g) An adequate number of appropriate receptacles for garbage and
rubbish, in clean condition and good repair at the time of the
commencement of the lease or rental agreement, with the landlord
providing appropriate serviceable receptacles thereafter and being
responsible for the clean condition and good repair of the
receptacles under his or her control.
(h) Floors, stairways, and railings maintained in good repair."

I did some research. We have complete grounds for breaking our lease and teh Navy will pay to move us onto base housing, where we can stay until we buy (we put it off so we can afford more). The Navy also has free legal services and our porperty management company is under investigation with them already for the properties they listed on the military housing website being unfit. It's cut and dry, but I thinkt he husband wants to stay here

 

We also noticed htere were NO SCREENS ont eh windows when we moved in. 10 days later and there are still no screens. They are measuring them on Thursday, but that's Thursday, no screens is a huge deal for me. I can;t paint until we get screens.

 

Also, there is no vent for our dryer hose and the outlet they put in the laundry room isn't even a dryer outlet! It's like they put in a fake laundry room to lure renters.

It did for us until we tried to hook our dryer up and realized it was impossible. The outlet looks just like a 220 or 250 volt, but it's not and who seriously goes and checks the laundry room for a dryer vent? I mean it's a laundry room, I don;t expect people to trick me into thinking it serves the purposed of doing laundry.
I am just so frustrated. i am callign the Navy housing office tommorow.
IU also looke dup the houses permits on the internet, none of the additions have permits. That alone is enough to break our lease.
I am going to call the Navy tommorow and get this worked out.

Yeppers, we're near Fresno now. We were going to buy a home in Fresno, but didn;t qualify for the home we really wanted, so we decided to wait and are living in a town with 2,000 people lol.

 

We are living in Armona Shelly. But my problem is I didn't know abotu the arsenic in the water or just the general dirtiness of the water so I didn;t check for water purification systems and all that. I am so frustrated. I have been really upset lately and not doing too well with my mental health. It's hard to tell, I am not showing it too much, but my insides always hurt and I am down to almost the same pants size I was in high school. Great diet plan, horrible quality of life though. I am thinking of going back to work full-time so we can pay off our cars super quick and buy a house in a better water district soon.
I just feel liek I am goign out of my mind. Liek I am really going crazy or something.
