my roommates boyfriend got busted

    On Friday, my roommate and her boyfriend went to this party at their friend's house. While they were there I guess the bf "T" picked up 2 oz from the party host (who deals maddddd weed) so anyway while they're partying, smoking and what not the cops roll up. My roommate, T, and 2 other kids ran away and hid in the woods for awhile. Another one of their friends picked them up and took them home.

    The next day, T goes back to grab his bag w/ his weed, scales, etc in it and the dude that had the party told him that somebody told the cops that it was T's bag. He wasn't sure if he was gonna get in trouble.

    Come today, he checked online on some majestrate website and found out he's getting charged for posession (2oz) and intent to sell (for the scales and what not).

    He's already on probation (was supposed to be done in December) and that's probably gonna make it a lot worse.

    The bag that had all his shit in it didn't have any driver's license or any form of identification on it, so he might be able to say it's not his? He left his car there, though.. so if they ran any plates they could find out that he was there.

    What do yins think will happen?

    Probably nothing; Its all circumstantial. Can they really prove that it was his baggie and scales? Or is it just somebody else trying to get off the hook. Even if his car was there he could have left it and never been at the party in the first place.

    if i were you, i would tell him to just deny everything, if they have no actual "proof" then im pretty sure they cant charge him ( do NOT take my word though )

    If i was him, this is what I would do, tell them that I was in fact at the party, and my car was there because I had a little to much to drink so i didnt want to risk driving home that was all, and have no clue about that bag

    That's what I told him to do. Just deny everything, say he was too drunk and had someone pick him up early from the party. I didn't think anything would happen about this anyway, but he's really scared about it, especially cause he's on probation and stuff like that.

    Ya they ran, but the bag with his weed and scale in it was still there at the house and the cops found it.
    No id found in it or anything though

    no i meant the next day when he went back to get it. why would he even go back if the bag wasn't still there?

    He didn't know if they took it or not until the next day, and plus his car was there.

    Probably run into some problems if his PO gets wind that he was at a party with drugs and alcohol present.But I doubt that they will be able to prove the weed was his,just deny everything.Tell the PO that someone used the car and deny being at the party.Good luck

    Tell him to deny everything can't prove it, they will probably offer him a plea bargain tell him not to take it, all this is used for is to get you to admit guilt by offering a lesser charge. And I highly doubt they would fingerprint scales for weed, it would probably cost more $ to identify it than the fine would be.

    O and tell him not to use a public defender since the DA has them in their pocket

    i dont understand WHY they would charge him but leave the weed?

    i still dont understand how they could possibly charge a dude that isnt even there, that they have no way of proving it is his either...

    if anyone, they would have charged the owner of the house
