I have to ask for advice on this...

because I want to know what to do if it ever happens. I'm talking about let's say I had an encounter with the police, and they found RC's on me (up to a couple grams maybe). One of the RC's that's not technically scheduled but could be an analog possibly (ex. 2c-i). What the fuck should I say to the cop about what it is, and if I was arrested how would I need to handle the situation after that point in order to beat the case?

mainly i'm posting here so i can see where this thread leads. but like i'd imagine they would have to confiscate and test to see wether or not what you had IS actually schedualed or not...

This is so simple.

Say nothing. It's not illegal. Don't have any paraphenelia around that would demonstrate the intent for human consumption, and don't have it in many small bags possibly for intent to distribute though that I think would have to be a controlled substance, still, so you could probably put RCs in bags but it would be risky.

I would just be clean and go to court stating you were investigating new plant fertilizers, or a lawn growth formula... Just sprinkle some on your lawn and take a photo and you're good, bring that to court with you. They have to prove consumption intent for unscheduled RCs.

You have the right to remain silent. Anything you say can and will be used against you in a court of law.

I wouldn't say anything that isn't true, like that you were a "scientist," anyone can "research," or do basic chemistry with plants, it's how we make them grow...

 

first step is to not be carrying grams of rc's on you and being in situations where a cop would search you.

Dito, if for some reason you have to have any amount on you traveling, do not talk to the police. They will o out of their way to get you to say something. but it really irritaites them when you won't talk.and your better off keeping in origal bag that says "not for human consumptoin" that identifies what you have is not drugs. They would have a hard time even holding you. I had to drive up and down a highway in Conn. , Mass. and Vt. known as the "heroin highway" by the state cops. And my having Vt. lic. plates on my car to them ment I was trafficing heroin. I had dogs in my car 6 different times. I had one state cop follow me 38 miles in one trip at 45mph on a highway . 65mph was posted speed limit. So it was obvious 'she' was following me. We had 4 cruisers on my car one night and they had a head on collissoin , and all cops were on me. They got in a small problem exspaining why they were hastleing me and not around for accident. They knew me vary well, they thought they did anyway. Always drove away. i would not talk to them. and they would get pretty pissed by the end of the pull over.

 

It may not be scheduled, but they can still try against you with the chemical on the fact that it's "analogous" to another chemical that is scheduled. But, first of all, that's if it's on you in a way that makes it apparent that it is for distribution, I'd suppose (where they get serious with the matter), and in a situation where it's apparent that it's obviously for consumption as well (pill capsules)

 

Just dont say shit to the cop. Theyre gonna accuse you of having meth, heroin or coke, and youre gonna get arrested. You will probably sit in a holding cell for a few hours, maybe even a day or 2. Still, dont say shit till you have a lawyer.

Also, dont be a dick to the cop. Youd be surprised how far a Yes, sir/No, sir attitude will get you.

 

Thats why I say 'if' you have to travel with it ,it has to be in origial bag with warning on it. as soon as you remove from that bag they can charge you with distubuting. They can do what they want anyway. and yes, never be a dick to them. it actually irretaites them when you are nicer than they are.i've had cops do burnouts in their cruisers past me when they had to let me go.Alot of times they'll arrest you hoping you'll plead out to the charges to. never trus them.

 

some cops are smart, but some are dumb as hell.

i have a friend who was illegally serched and the cop found 3 mdma presses, 3 sugar cubes and a vial.

the tested the presses, and came back for mdma...they tested the vial for "heroin" and it came back clean...when the cops asked him what it was he said he chews up his E, and it tastes bad so he eats a sugar cube and takes a breath drop.

spent a night in county, and charged for the mdma. His PD got him off completely because he was illegally serched in the first place.

it sucks because they threw away a vial with ~90 doses in it...BUT he got off completely.

 

so I should not say anything to the cop explaining what it is when asked. like just tell them straight up that you're not saying anything. So I shouldn't even try to tell him it's fertilizer or w/e?

 

Technically, you don't even really KNOW what you're getting from a vendor. You're just reading a little label and putting your trust into them. So, by those facts, what could you tell a cop? They will see it, and all they can do based upon it's appearance is make assumptions as to what it is. So, if it's in a nice labeled bag that says the exact chemical name and the intended use, then I guess you're in luck. And I would stick to telling them exactly what the label says. "This is what it should be" and this is what it is "intended for". It's not scheduled, and the way it appears can not be proven to be related to drug use. So, let's just say fertilizer for gardening.

If it's in a pill capsule, then you'll have a bit of explaining to do, as they can potentially bring you to court and charge you as it could be considered 'analogous' to another drug, and it will appear obvious that you are distributing it for money to another or for personal use.

 

For the love of god do not make RCs a target for LE. Just don't. Ask yourself before you leave your house "Is what I'm doing risking real harm to legal entheogens". If the answer is yes, go back inside, and leave your shit in there. you can buy presses and shit at the club. Only spread this stuff if you know what you're doing.

 

you've got a good point about that, alot of bullshit can be avoided by leaving your shit at home. However I was mainly thinking about the trip from the post office where I pick up my chems. That is when I am mostly worried. If at all possible i don't bring shit with me when I go out, and if I do as little amount as possible, preferably not more than I could eat. I don't open the package until I get home that way I don't have just a bag of powdered substance sitting out for a cop to find, could the cop open a package to find out whats inside? I've been pulled over by some asshole cops that would have gone to the end of the earth to find anything they could so they could arrest me.

tell them you refuse to disclose what it is and make them pay to get it tested. Then tell them you will fight the charges and they will likely either drop them, offer you a plea deal or lock you up for a decade or two (but since you didn't have a lot this is very unlikely).

 

Yes, the cops can open your mail when they gain the ability to search you legally. Mail is only legally "mail" when its in the govt mail system. Mail in your hand, not qualified. FBI has used this trick on high up drug dealers many times.

 

In this situation the proper course of action is to say nothing to the cop. You have the right to remain silent.

In order to beat the case, hire a good lawyer and follow his advice.
