I just opened the mail

    I got a letter from the child support agency. If you will recall, I had a paternity test not long ago and was proven NOT the father.

    I read the letter, and they are trying to take child support from me. How does that work? I never even signed a birth certificate either..

    Of course it's 5pm on a saturday and i cannot take care of this.

    They can't do that, can they?

    Do you have a copy of the paternity test results?

    If so, call them on monday and fax it to them.

    Doesn't seem right to me. I'd fight the hell outta that shit, if I were you. If you end up having to pay child support, then you should be able to see him whenever you want.

    tell them youre the mother and the check should come to you, see how long it takes em to get it all straight!

    I was just thinking the same thing. This could be my ticket to taking control. If I pay it, then I get rights, right?
    Could it be that the CSEA sent it out by mistake, just because they aren't used to negative paternity results?

    Of course you'd get rights. Child support guarantees it, I think.

    I know this phrase is really overused on the HF, but if you have the money, I would talk to a lawyer.

    I would take this very very seriously. Get on top of it right now and have a legal professional get you out of this.

    You can be asked to pay child support if you have been supporting the child all along. Even if you are not the father. You legally assumed the role of provider for this child and that is precedent.

    The good news is that if you are ordered to pay child support then you have the right to request visitation.

    I doubt he'll be required to pay child support though, considering he only RECENTLY found out that it's not his biological child, after 3 years of thinking he was the father.

    But yes.....if you want to have some visitation, then this is your best chance and will be worth it, without a doubt.

    Well it happened to someone who I know who never thought they were the father and it was never claimed that he was. She was pregnant when he met her. He was a provider and the courts ruled that he had to continue to pay as had been prominent in the role of a father. Along with spousal support for a common law partner of 3 years. :)

    Well that's kinda fukt up, honestly.

    I'm guess the guy was able to see the child, right? Like I was telling Death a few days ago.....a good dad who ISN'T the biological father is better than a shitty dad who IS the biological father, so hopefully he'll still be able to be in his life.

    Yes he has full access to the child which is a blessing for him. In his case it worked out for him as that was what he wanted and the spousal support is only until the child is in school full time.

    Any person you live common law with who has children who you support can then sue you for child support. The law equates it to having taken parental responsibility and a continuance of obligation to the children. You do not have to be the biological parent. If the child has a biological parent who pays support then the common law partner can still be held liable for a portion of support or not depending on the courts. Usually not unless you can show that the standard of living is going to be adverse for the child without the support of the common law partner.

    Lawyers love this stuff, it buys them many toys. :(

    thank god, you know how much that shit costs? i had a buddy that fucked up and had a baby and his paycheck is slashed in half for child support which the mother spends on oxycontin and cigarettes
