system screwed family

    hi there, our brother in arkansas, day brown, waited for 2 years for a trial <for growing and then they bumrushed him thru the system . in one day they picked a jury , releasing any juror who answered yes to 'do you think marijuana should be decriminalized, and on the same day had the trial and sentenced him to 16 years. his family is unable to find out where he has been taken. any suggestions? I am in oregon and unable to do much from here.

    i believe you are entitled to a speedy trial. the public defender had every right to question the jurors as well, and anyone with a predetermined opinion about a policy (like decriminalizing marijuana) is not going to be an impartial judge of the facts. of course, anyone whos preconceived notion is no is also not an impartial judge. so, shafted by the system? yes. but its typical.

    if he had to wait 2 years and then his lawyer failed to even try to get him off the hook, that just sucks. but i rather think theres more to the story.

    Violations of the principle, such as where the state has failed to bring the case to trial for an "unreasonable" length of time, may be a cause for dismissal of a criminal case...

    unless your defendant asked for continuance, then the trial should of been over in 120days.. .

    How do you know that this happened ? Because he is missing or because he does'nt want to be found.
