Well, Saturday night was turning out like like they always do. party's drinking and smoking. Two friends and I, we hanging out at my my house. watching T.V. and smoking some weed. we get a great idead to call these two sexy girls, go pick them up from some party they were at and bring them back to my house. this was around 11pm. so we light up a few joints, smoke them and pack a bong full of some dank bud my buddy had. We finished smoking around 12:30 am and just watched a movie with these girls. By this time it was 3am and i was ready to take these girls back to they party they were at before we picked them up. I'm driving with my 2 buddys and 2 girls in my car. we make it back to the house were they party was, but only to find the house had all the lights off and a car leaving the house. Also by the time i get near the house another car is in the other lane about to pass me. We all realize that is a Sherriff and eveyone in the car says just keep going.(It was a party house i figured the cops busted it up or somthing and i didnt want to atract attention) so i keep on going then the cop does a u-turn and gets behind me. this is just like a one lane road in the counrty. So with the cop behind me i need to make a right hand turn at the stop sign. i turn on my signal, stop, count to 3. then go. the cop still follows me as im still going down this small bumpy road going about 35-40 MPH. i thought i was driving perfect. using my turn signals and stopping. i come up to the next stop sign, turn on my signal, then make the turn. next thing i see is Red and blue light's from behind me. i say SHIT! in my head. The cop comes to the passenger door. i give him my liscense and insruance. he said he pulled me over because i was drifting back and fourth on them country roads(touching the white fog line, not the center yellow). He also said i took too long at the first stop sign. and said i was driving under the speed limit. i look to him in disbelif and tried to explain myself that it was a small road that ive never drove on before and i dint see a speed limit sign so didnt wanna get pulled over for speeding so i just went 35-40mph. he then asks me if i have been drinking or smoking that night. i clearly told him no. he comes back after running my info. asks me to step out of the car, tells me to sit in his cop car. then proceds to interogate my friends. Well the 2 girls got to call their mom and got to go home. my 2 friends then had to sit in the back of a cop car till their ride got there. (all of them under 18,im the only "Adult" at 19) then the cops gets me out of the car, and starts to do a sobriety test. he tells me to do the heel to toe walk and count out loud to go 9 down and 9 back. i do that. cop asks me to stand on one foot with my other foot 6 inches of the ground and count to 30 by one thousand 1, one thousand 2, and so on... It's 3am now. like 20 degrees outside. and i had shorts on the most nervous iver ever been in my life.. i get to like 10 and my leg that im standing on is shaking really bad. i can hardly stand up. i get to about 20 and my whole leg is shaking barley holding myself up. i touch my heel to the ground to regain balance. and finish all the way to one thousand 30. then comes the Eye test. i hold my hands on my cheeks and watch this asshole's figner go up and down and side to side for about a minute. he puts he hand down. signaling the test is over. i look away for a second and then he says "You are under arrest for operating a motor vehical under the influence". the cop said i took 11 steps down and 9 back. My heart sank. i felt it hit the ground. i get stuck in the cop car with handcufs. they proceed to search my car ,find a bowl that hasnt been used in weeks that i kinda forgot was in there. i got takin to the police station. i tried to pee in this dubass cup, but i couldnt. i was just so nervous and pissed at what just happened it couldnt go(in the whole 5-6 mins they gave me). so they marked it down as a refusal(usually means automaitc 1 year suspension) after i failed to go pee. i got to call my mom and had her pick me up and went and got my car. i had court today. i plead not guilty and am awaiting to speek with a public defender to see if i can get anything dropped or reduced. so now im waiting on my next court date. i smoked about everyday for that past year and a half. i have a pretty high tolerance. i was not driving high at all. not even a little bit. i smoked 3 hours before!! i just cant belive that i got charged with an OVI any advice? dang, this came out longer than what i thought it was going to
Sounds like they don't have shit on you except a resiny pipe. Sounds like an asshole cop fucking with you because you were having fun with cute girls and he was out in the cold with nothing better to do than be a dick. iggy: Just dress sharp for court and plead your case.
That yeah thats horseshit dude, like Geprodis said dress sharp and present your case lol I dont understand why cops are such fucking dicks about stuff like this.
You can demand a court hearing challenging the officers grounds for demanding a sobriety test. Go the the NORML website to research the DUID laws in your state.
Good thing you didn't pee in the cup. They have no evidence against you. Get a lawyer and get the charges dropped.
update: my lawyer went to court for me on Dec. 17th. my OVI got reduced to wreckless op. and my other 2 charges got dropped(paraphernalia and the little traffic ticket) so far im pretty happy. im waiting on my next court date in the mail. so i'll see what heppens then!!
a little late, but heres another update. after i got the carged drooped and reduced, i also got 5 months of probation, i had to goto this "lifeskills" class and gradute before i was let off probation last may. i started probation in january, met my p.o. (she was actually pretty hot) and dropped dirty the first month(i actually smoked 2 grams the night before). i slowed down ALOT, to about 3-4grams a week and even quit for like 2 weeks. but i didnt quit smoking, so i dropped dirty in January(1st month of probation) and after i dropped for febuary my p.o. said she could tell i quit smoking becuse my levels of THC were significantly decreased. well i went on with smoking and i was just lucky, she didnt drop me the rest of my probation. and since may 2010 ive been off probation. i did end up with a 1 year license suspension and court fines/fees, but atleast i dont have a fucking OVI on my record. the judge said my 30day jail sentance is suspended. but if i get caught again with another "OVI" in the next 2 years that i will get the jail time. i just want to find that cop and tell him how he has wasted a year of my life. driving is my LIFE. thats how i get to a job(that i dont have anymore) friends family and its how i do EVERYTHING! this stupid ass cop wasted a year of my life because i was driving @ 3am on a small ass country road. i dont get my license back until next month sometime. hopefully i can get a job and get on with my fucking life. oh how i hate dumbass cops!!!!!!!!!!!!!!! So, in total i got fucked with: $1000-laywer $475-reinstatement fee $300-courtfee's/fines 5 months probation a car that proably needs work because its been sitting for a year. and last: 1 year of my life wasted what aggravate's me is, ive been drunk as fuck puking ,pilled out for days,coked out and i never ONCE got pulled over for "OVI" but i get pulled over 3 hours after i smoke a blunt and get chagred with a fucking "OVI" love the cops!! ok, this ends my rant and hopefully i can move on with my life.
Holy shit dude... Some cops were probably just the douchebag in highschool that could never get over not getting invited to parties... Wow though, the asshole said you were under the influence when I would've passed you if I was that cop, I can't believe he just pulled that shit for minor technicalities just because he wanted to fuck with you. Well, at least he got his wish: he ruined your night. I hope he's fucking happy. Hope the future holds better for you.
