Ignatieff, however the hell you spell his name, probably won't be much better. And we all know an NDP, BLOC, Green Party, or independant will never win. It's always either PC or Liberal. He was in American politics for however long then came up here to try his chances at Prime Minister. He's spoken about decriminalization but apparently supports Harper's 'Zero Tolerance' bullshit.

well its over 5 plants which is more than anyone would need to have growing at once for personal use so its a law against distribution of an unregulated product which they see as an evasion of taxes... it could be a whole lot worse and it is here in the US. 6 months would be 4 with parole big fucking deal how about just grow 4 instead of standing up to the man haha

Under the laws for medical marijuana in canada, a person is allowed to grow up to 5 plants (indoors) PER daily gram they are prescribed.

Prescriptions range from a gram a day (rarely) to in some cases over a 100 grams a day (for people just injesting it). The average prescription is around 5 grams per day, which allows 25 plants.

There is alot of truth in that sentence. Here in the sunshine state possession of 20 grams of marijuana, again that was 20 grams is a felony with a maximum of 5 years in prison.

Again, you seem to be skipping this part of the bill;

The bill also includes mandatory jail terms of 18 months for extracting and sharing hash or making pot edibles. This means medical marijuana users who make pot cookies would be at risk of arrest, as there is no protection of this activity by current medical marijuana laws.

Does the bill actually say "The bill also includes mandatory jail terms of 18 months for extracting and sharing hash or making pot edibles."

Because if it does, that doesn't change a single thing except in terms of the sentence... That inclusion of "AND sharing" makes this the same as trafficking is now.

At least in terms of medical usage... you are not supposed to share any type of prescription medication....

Cannabis and Hash are both Schedule II drugs

"The current section 7(2)(a) of the CDSA makes the production of a substance included in Schedule I or II of the Act, other than cannabis (marihuana), an indictable offence with a maximum punishment of imprisonment for life. Subsection 7(2)(b) of the CDSA makes the production of cannabis (marihuana) an indictable offence with a maximum punishment of seven years’ imprisonment.

If the substance produced is one listed in Schedule II, other than cannabis (marihuana), new section 7(2)(a.1) imposes a mandatory minimum punishment of imprisonment for one year if the production is for the purpose of trafficking, or for a term of 18 months if the production is for the purpose of trafficking and any of the health and safety factors listed above apply. If the subject matter of the production offence is cannabis (marihuana), subsection 7(2)(b) will double the maximum possible term of imprisonment from 7 to 14 years."

This is one explanation. There are many more.

Overcrowded federal prisons are becoming "warehouses for bodies" that make criminals more likely to re-offend when they are released, according to advocates for the rights of prisoners.

Concerns of academics and social justice activists reverberated in Ottawa yesterday, with the release of a report by Howard Sapers, the Correctional Investigator of Canada and Federal Ombudsman for Prisons.

According to Sapers, conditions inside overcrowded prisons are preventing rehabilitation.

These conditions are leading to more incidents of violence and preventable deaths in custody, and the people hit hardest will be the most vulnerable segments of the population, including those struggling with mental illness, according to Sapers.

"As a society, we are criminalizing, incarcerating and warehousing the mentally disordered in large and alarming numbers," Sapers wrote.

He noted that Aboriginal people are also vastly overrepresented in the prison population.

The federal government, while pushing for mandatory minimum sentencing, has announced millions of dollars in new money to expand federal prisons.

Critics have responded that an enlarged prison system and severe punishment will make matters worse.

"The knee-jerk reaction is to build more prisons," said Peggy Chrisovergis, a doctoral student in criminology at the University of Ottawa.

She said that even as crime rates are declining, prison populations expand with the application of severe modes of control and surveillance.

Parole officers can put convicts back in jail based on a condition known as a "lack of transparency." In at least one case, Chrisovergis said, an officer applied this punishment after a convict failed to disclose breaking up with his girlfriend.

"Lack of transparency is used much more now," Chrisovergis said, adding that parole officers have entered into even more intimate territory in some cases.

"Parole officers will call your girlfriend and ask questions like 'how's your sex life?'"

And as prisons fill beyond their capacity, convicts are forced to share cells designed for only one inmate, a condition known as "double-bunking."

Marie Beemans, a longtime advocate for the rights of prisoners, said that double-bunking is leading to more violence behind bars.

She said she doesn't expect riots on the scale of riots of the 1970s, when prisoners took over the Kingston Penitentiary for four days.

But as rates of violence increase among tense prisoners, it becomes harder for them to make their way back into society when they are finally released, she said.

"When they do come out, you're getting people on the street who don't trust, who are on the defensive all the time," she said.

"This is not protecting the public."

Apparently someone jumped the gun on this one. Great news! It has not passed the Senate yet and hopefully it will not. A reporter from the Vancouver Sun named Janice Tibbetts wrote in an article Monday, "The Senate has backed away from a fight with the Conservative government and passed a controversial drug-sentencing bill that would automatically imprison people caught growing five or more marijuana plants."

I don't know why this reporter wrote this, but it is not true, yet. And let's hope to God, Allah, Jesus, the Universe, or who/whatever else you believe in, that this bill does not pass!

Despite reports from the mainstream press and Cannabis Culture, Bill S-10, the Conservative legislation that includes mandatory minimum jail sentences for marijuana crimes, has NOT passed the Canadian Senate. S-10 passed Committee, but the Committee report remains in the Presentation and Debate stage before third reading in the Senate.

In a Vancouver Sun article titled "Senate passes bill with mandatory jail sentence for growing 5 pot plants" Postmedia News reporter Janice Tibbetts wrote, "The Senate has backed away from a fight with the Conservative government and passed a controversial drug-sentencing bill that would automatically imprison people caught growing five or more marijuana plants."

Cannabis Culture reposted the Sun article on Monday with further comment and information about contacting your Member of Parliament to help stop the bill from becoming Canadian law.

Upon further research by this reporter, it turns out this information was incorrect. According to government documents, Bill S-10 remains in Report Stage before third reading in the Senate. CC apologizes for reporting the incorrect information.

When I first reposted the story on Monday, I noticed that the Parliament of Canada website page for Bill S-10 showed the Senate Committee Report had not been approved, and the bill had not been through 3rd reading. Thinking the website just needed to be updated, I assumed the information from the Sun (and other activist websites) was correct.

When I saw today that the information had not changed, I called the the Parliamentary Information Service who said the website had been recently updated, though they couldn't actually confirm whether the information was correct. After a look through the Senate Hansard for November 24 and a call to the Speaker of the Senate's office, I can confirm that the bill has not passed and remains in the Report Presentation and Debate stage.

This is good news as it means that the possible passage of Bill S-10 will be delayed further, giving us more time to organize against it - though it will most likely be passed by Prime Minister Stephen Harper's stacked Senate.

Bill S-10 includes mandatory prison terms of six months for just a few plants. These mandatory sentences increases to a two-year minimum for growing or dealing near a school or park, and even more time with other 'aggravating factors'.

The bill also includes mandatory jail terms of 18 months for extracting and sharing hash or making pot edibles. This means medical marijuana users who make pot cookies would be at risk of arrest, as there is no protection of this activity by current medical marijuana laws.
