if you're educated in any law stuff.. please help.

    know anything about driving/juvenile/court appeals/etc.? bare with me, I'm gonna try to make this long story as short as I can.

    My guy's drivers license was suspended when he was 16 in TN. He had to complete 76 hours community service, a drug education course, and a year probation, and fine (of course). He got all this shit transferred to Indianapolis cause he moved afterwards, where he completed it all except for the fines. Well now he's 23 and we've been trying to get his license.

    So we went to the DMV to ask what he needed to do to get his license, they said go to the court clerks and get an order of withdrawal.

    so we went, they told us to get an order of withdrawal he needed to pay a 400.00 fine... fuck, that sucks, right?

    so we went back a few weeks later and paid the fine, the lady gave us the receipt and told us to go across the hall to the judges office and the lady there would give us the withdrawal.

    (what a rat race)

    Well the lady at the judges office takes our little receipt and tells him he needs to have proof of 76 hours of community service and the certificate from his drug class.. Fuck again..

    well we finally got ahold of his PO in Indianapolis and she said his records were destroyed when he turned 16,
    which makes sense to me, but not to the lady at the judges office.

    Anything we can do- we have a 3 month old baby and I have to take him to work, pick him up, blah blah. It's rough. We're spending double the gas and double the time. It just seems like we can write a letter or something. Oh and we have a lawyer who is suppose to be working on it, and is apparently waiting from a response from his Probation Officer in Indianapolis but he can't get ahold of her. So, I kind of just want to try to take care of it myself and that'll save us the 300 dollar lawyer fee.

    i would think even if his slate was cleaned after turning 18 (or apparently 16 in this case, although i kind of think that may have been a typo anyway since the case involved him driving...) that there would still be some record somewhere of what happened earlier. but i really don't know much about it, so i can't offer good advice or anything. all i can say is it will almost definitely be worth it to keep the lawyer.

    although if your lawyer is on probation in indy, then maybe you should be seeing someone else...

    go to a state Representatives office, should be one very close to you in your town.. (there you can get direct access to the DMV - and also plea your case a little to rep, explain to them the hardship and the run around.. They should be able to fix the matter for you faster than the DOT-DMV .. impe thats what state reps are for.. when my brother was getting DUI's on my license and the state/local police, dmv wouldnt do anything. I went to the state rep and had it fixed in a few hours. write you case out just like you did for us.... Good luck.

    Oh man, wish I had some advice for you, but me and my boyfriend are in a similar situation. Every time we try to get his stuff paid off to get his license back, they stack on yet another amount. We finally just gave up, he drives anyway, just double checks the headlights and tail lights and obeys all the traffic laws, so they leave him alone. But it sucks ass because the whole no license shit is keeping him from finding a job. It's a vicious cycle. Grrr.

    I had to pay a pretty hefty fine for 3 tickets I got one night in Dallas. No Insurance, bad taillight, inspection sticker overdue. It took me like $600 to get my car out of hock, so I didn't pay the tickets right away.

    They suspended my license, and I had to pay the tickets and reinstatement fee. This was in September '09. Well in July this year, I found out that my license wasn't reinstated simply by paying the fine, and I had to mail in a petition to get it reinstated.

    I live across the world now, and have a Cambodian drivers license. If a cop pulls me over and I have broken the law, it's about a 3000 riel bribe. 75 cents.

    It's happened twice because I forget theres you can't turn right on red here. It sounds corrupt, and it is. But the government office that employs traffic cops pays them $50 a month.

    Rather than what happens in Dallas, in which there are place the police won't go, and are pretty dangerous because of that. Instead The Dallas police department devotes their resources rigidly enforcing traffic laws to routine traffic stops in highly trafficked areas to generate revenue for the city.

    Corruptions a funny thing.

    You mean that he drives with no license and the ramifications of no insurance then?

    i worked at the district court level in PA. there's nothing they can do. the state rep is the next level to deal with. They HAVE to make sure you get helped. Well, at least that's their job...

    And when records are destroyed, they truly are. Info is pulled from digital storage and everything physical except a ref. number is shredded.

    No...we have insurance. Not all companies insure unlicensed drivers but Progressive has no qualms about it.

    He is insured but not to drive? They can not insure a driver without a learners permit or license to drive. They can insure them if the own the car, in other words they insure the car and other parties but not the one who has a suspended license to drive.

    We have uninsured drivers insurance as well. It's much safer for him to drive most of the time anyway, I can't see at night and need glasses pretty bad, but since we can't afford to get his license back, we can't afford to get me glasses. His name is listed as the insured driver, and it's liability, so if it was our fault, we'd be boned anyway.

    It's worth noting that whomever owns the state trading corporation (i.e. PENNSYLVANIA, STATE OF) actually owns the car, and that probably goes up the food chain from there... Right of possession is not the same thing as possession, with the beneficiary having transferred the liability to themselves & become trustee.
