I just got one... 0.11 (limit is 0.08), and a first a offence in Minnesota. I complied with the tests, and wasn't sent to jail, but my car was towed and my licence will be revoked. Got court in a month. Was wondering what I should expect, and if I can fight it. For those with experience, how did it go for you and what did you blow? I hope I can get this one off my record. it's different in every state, so it's hard to say. i know here there's no way to get it off your record, ever.
yep, 6 beers and drifting over a curb, pretty much fucked my insurance . Definately learnt my lesson, even tho driving after a few beers sounds like an awesome idea its really not.. get HIGH and drive not drunk .
I'm from MN, and I know quite a few people with DUIs. It's quite costly. Pretty much have to be an idiot to drink and drive these days. Just sayin' As for fighting it, well, did you drink and drive? Perhaps if you can afford a lawyer you may have a chance to knock it down to something less, but I wouldn't count on it.

No in all honesty I was never a big drinker, but I did get a dui 5 years ago when I was in a relationship with someone without a lisence and basically his chauffer- in the 2/12 years as his DD- one night I was stupid as we were in an argument and drank too much an got a dui. I never enjoyed it anyway, owned up and well, actually straight up quit drinking since. I guess I never took it as a lesson from the law, i just took it as a time to do some personal reflection and also face the fact that I shouldn't have been drunk and driving.
fuck the drunks who drive...if it were up to me Id take away your license for life and put you in jail for a few years
I live in the only place in the first world with pre-trial adjudication for DUI. And I'm on two years probation by their hand, for fucking art. You dun fucked up when you blew. It could take years and thousands, but if you refuse all tests (unless your under 21, when thats usually implied consent or whatever, saying you are drunk... some sort of what have you got to hide bullshit) and if you're not obviously drunk, or in a wreck, or swearing at officers and stumbling (gotta look good for their dash cameras and shirt pocket recorder) you very well may get it dropped or lowered. Basically they have cold hard evidence, and you don't have a hope in hell of fighting it. A lawyer might be able to sweet talk them for you and get you lower penalties. But you're NOT going to get it dropped or reduced having blown. Not sure if you can get a DUI expunged, probly depends on your state... or sealed, at least. But chances are the court won't, at least for a long time. That shit's on your record for a while, if not forever.
Breathalyzer tests can only approximate your BAC, so it might be off a bit. (If that's what you took and it wasn't a blood test.) 0.11 is kind of close. Maybe a good lawyer could argue that there's not enough certainty that you were actually over 0.08. I'm not sure though.
why dont people ever just man up and take the consequences of their admitted actions instead of trying to lie their way out of everything
Well, to be totally fair.... It's quite possible the brethylizer was really off, and he was legal. I took one (wasn't driving) and was not impressed with how it functioned, or how the officer seemed to be manipulating it, or trying to. Nonetheless, I think I may have blown lower than my actual BAC, .09 after an OE 40 and a standard beer. That means when I'm 21 I could drink a 40 and be legally set to drive in like an hour... which I honestly doubt. Anyway, the things are fickle and inherently inaccurate, depending on all sorts of things like the vascularity and size of pockets in the individuals lungs, etc. I don't think they're legitimate tools for... anything. So okay, maybe you can fight it on that, OP.... but likely not. (I've also heard tell of smashed people blowing 0.0, or sober people blowing rediculously high amounts.... I'd decline one just based on that, they're not trustworthy and their operators are not trustworthy)
Simple rational self-interest. I don't see why anyone should just let themselves be punished if it's possible to get out of it or get a lesser punishment.
yep..you're right...we need to start working on getting rid of the possibility for people to get out of punishment they deserve..or getting off with less than appropriate punishment no wonder there's so much trouble in the world
my brother had a dui or two. then he got in a wreck and committed dui vehicular manslaughter.. went and got locked up for about 7 year. got out on parole and got another dui.. not smart.
Woah. He killed someone, and then had the audacity to touch alcohol again? Circumstances that would make all of those understandable are possible, but highly doubtful. He's probably one of those that should be handcuffed to his bed for the rest of his life.
The purpose of punishment is (or should be) to deter certain behaviors. Unless you're planning on doing it again, it doesn't really do anyone any good to have punishment meted out in any single situation. To actually "deserve" punishment implies retribution, which is a primitive and irrational desire.
