maybe I should punch you in the face and rape your mother and then we'll see your primitive and irrational desire for retribution

I could probably weasle it down to a simple assault

Hope that was a joke. We'll see what happens I suppose. Luckily I am in my last year of school and can ditch driving. Plan to work abroad as well....

    le sigh :)

Yeah, you done and fucked up good.

But driving with a .11 BAC doesn't exactly make you a monster either.

He won't get all those, that would be like sextuple jeopardy.

Frankly I think that's fucked up. He deserves something bad, but I don't know if 6 years in jail for a car crash, with a vehicle that people knowingly got into, having been drinking with the driver, is really acceptable. Maybe house arrest, maybe very strict probation/supervision, etc, but I don't think 6 years mandatory time is okay. His friends where as stupid as him for getting into the car, and stupider than him for not protesting (if not outright yanking the brake) when he was driving that fast in that sort of area.

Of course they didn't deserve to die, but it was STILL by their own hand, as far as I'm concerned. It would be different if they where just walking down the road and he ran them over.

Of course, I'm not making this post in defense of drunk driving, or not in defense of THAT sort of drunk driving or even that sort of person. But I still don't think that punishment is right.

Yeah, it's the speed/reckless driving that's really just indefensible and by far the worst thing he did. But that doesn't seem to get as much attention from the media as the drinking part. Don't get me wrong, he shouldn't have been driving. But his BAC was only about 0.12, which isn't good to drive by any means, but it's not that far above 0.08. It's only "5 times the legal limit" because he's like 14 months short of 21.

Because people later regret their stupid actions and they want the world to go easy on them.

"I was stupid, I swear, it'll never happen again..."

"Sir, my client would like to plead stupidity."

I agree. If someone drinks and drives it should result in the immediate permanent loss of their license, and some jail time, depending on the incident. It basically says that one isn't mature enough to operate a vehicle that weighs a few thousand pounds.

...it isn't stupidity. BAC limits are set preposterously low.

Ya i mean some people DO learn their lesson and dont do it again because of all the drama you have to deal with when you do fuck up. Like me, I had to wait a year to be able to even get my license back even if i DID have money for insurance now. Yeah, cant legally drive now, my insurance rates are fucked, feel like a dumbass now forever i dont give a fuck i already feel like that after so many people always calling me a dumb person anyways.
Anyways two duis would be lamer than lame so ya my limit is 2 beers now even that i am worried about breathalyzer.

Doesn't matter. If one wants to drink a beverage that inebriates them, affects their reasoning (usually for the worse), and slows down their reaction time and mental capabilities, take a cab. I don't even understand how people get behind a wheel after drinking. Sheer stupidity.

We can say, one or two beer is alright," but the truth is that alcohol affects everyone differrently, so it's hard to go by a case to case basis.

I'm not advocating drinking and driving - I just think that the penalties and and BAC limits are ridiculously out of proportion compared to any other risky activity. You're much more likely to kill a child driving thirty kilometres over the speed limit in a school zone, but nobody will take your car away or send you to jail for that. Or running a stop sign. Or passing on the right. Out of all the equally dumb and dangerous things people do while driving, this one happens to be punished out of proportion compared to the rest.

Yeah... and passing on the right's legal in my state, they made me do it during drivers ed :p

It really is out of proportion. Stupid, but it's also an easy scapegoat.

Getting tough on crime gets votes. We're going to clean this state up- lock up the drunks for life, and shoot dope dealers where they stand on the corner!

The funny thing is the same people who vote for the guy who says that drive after a beer and enjoy a joint in the evening. It's only when those OTHER people do it that it's a problem

    they will here

school zones are automatic double penalty which makes 30 over a careless/dangerous and/or racing charge....impound and jail is definitely an option they have at that stage

Yep, speeding, driving recklessly in a school zone is taken very seriously here. Same with drug charges. If you're caught, drinking, smoking (weed), or dealing in a school zone, you're dealt with very differently than doing any one of those outside a school zone.
