Hey everybody, My name is Ryan, I'm a 27 year old from NJ. I have abused oxycodone for the last almost 4 years. I finally decided to kick the habit! I bought four 8mg suboxone. Got through the first 2 and then got arrested last week with a dime bag of weed and the last 2 subs. :-(. I have only been charged with Marijuana once when i was 19 and have stayed out of trouble since then. If anyone knows what kind of trouble i'm looking at, please inform me, i'm afraid i may go to jail
I don't have a lawyer at all, can't afford one. How serious we talking? I mean I didn't get taken to county, they didn't impound my car, just wrote me a ticket for the 2 subs wich was possession and a ticket for the dime bag of weed. I work full time and have always been and still am a functioning member of society. Always have had a steady full time job, don't get into trouble (aside from the current problem) and I'm very respectable and did not lie about what i had or where it was in the car. the officer said he will try to tell the judge i was very respectful and forth-comming. I understand I'm in some sh*t here, but am I facing Jail time??? Any information is a HUGE help, Thanks for your reply Jaredfelix
you could maybe get jail time i cant say for sure you could always get lucky, expect the worse i guess, and pray to get off easy
Listen man, i'm in the uk so the laws a little differant, however ... 2 pills and a little bit weed lol i would'nt sweat it at all man. You won't go to prison over here £40 fine probably. You have a good record and you work therefore are able to pay a fine. You have nothing to worry about.
Wow thanks for the reply bud, I've been freaking out since friday night. I mean everything i read says first time you can face up to 6 months in jail, and the cop did say it was a pretty serious thing. I mean i am trying to clean my act up, and I had 2 subs which is for detoxing. I didn't have any oxy or anything like that. I'm just frusterated...One step forward two steps back ya know? :/
All I can advise it to get a good lawyer. I have seen people in worse situations get off with just two month's probation, so don't despair.
Honestly - that doesn't seem that serious at all. It's like you had coke on you or something. My friends been caught with much worse than that & he didn't do any jail time.
Im in NJ too, the laws are fucking serious here. If you have priors, you will go to jail, sorry. If its your first offense your looking at probation.
Yeah, no offense to the dude who posted from Scotland, but this ain't the UK. They have a more liberal justice system over there. Here, we have a "war on drugs", and they're serious about it. To the point that we've got over 2 million people locked up in federal, state and county lockups, and about another 5 million on parole or probation. And about half a million are locked up for drugs. Anyway, Suboxone is a schedule 2 drug, and since you only had a couple I think the max is about 6 months, which would actually mean half that time in county. But you won't get the max, unless you have a serious record. Probably probation dependent on progress in some sort of drug treatment classes, which of course aren't free, a probation fee, and probably a fine. Yeah, gotta keep that machine funded.
i think in your case, it doesnt look too bad. one prior but you were in your teens, possession of subs but you could say that is a good thing compared to oxy. Might get jail not sure sorry.
I'm guessing probation and some classes. The hard part will be paying all the damn fees they throw at you. It's not like they caught you with a meth lab. I know a guy who got caught with a bunch of Xannies and got 2 yrs probation and some community service, and of course classes, which are a joke, because it's just a bunch of people sitting around talking about getting high. Actually, those classes are where some people make new connections. But anyway your case sounds like simple possession, so they probably won't hurt you too bad. But they'll sure as hell roll you for some money, because that's part of their agenda.
Idk about nj but i believe michigan it's considerd a class 5 narcotic which is juss as bad as having 2 oxys...goodluck man, fucking faggot ass cops.
Actually, Suboxone is a Schedule III drug. Perhaps that will help the OP or not? I just wanted to clarify.

The subs would get u a felony here in MN. if its your first time you can say u are an addict. And get off with what sounds like some needed treatment.
idk it,s to bad it costs so much to go to the doc and get on subs leagely. it would save alot of people hassels like yourself. be sure to tell the judge you were useing them to get clean.
Yea unless he has a record and even then with how packed our jails are I highly doubt they would put a addict trying to get clean in jail for just under a year. Should be rehab like something and a slap on the wrist. Judges don't have time for stupid shit like this.
Yes. Just the fact that he was caught with SUBOXONE will have a big impact on the judge. First of all, like I said, it is Schedule III, not Schedule II. Secondly, the OP has documented history of drug abuse and he can probably successfully argue that his possession of Suboxone was actually a legitimate attempt to get clean for good and that he simply didn't have the money to go the "legal" route of seeing a Suboxone doctor and all. Although the stigma of addiction as a character flaw is still present, a good amount of courts are listening to science and realizing that addiction is due to REAL changes in the brain just as much as any "weakness" in oneself. I see the age of incarcerating people with POSSESSION without intent to distribute coming to an end in a decade. If the courts really want to rehabilitate people, they would set the accused person up with an appointment WITH a Suboxone doctor and a psychotherapist. That would be an ideal solution AND would cost less than incarceration.
