Does that mean that the pope is going to be as understanding of his own "employees" who do not follow doctrine or law of his boss?

I wasn't referring to the U.S. Constitution, which says nothing about a right to civil disobedience or conscientious objection by government officials in ignoring laws for personal religious reasons. I was referring to the moral conditions established by philosophers and practitioners of civil disobedience. Although the First Amendment rights enjoy a "preferred position" in the Bill of Rights, no rights are absolute. As Justice Holmes famously pointed out, no one has a right to cry fire in a crowded theater, and the Court has set reasonable limits on the exercise of religious liberty when it comes to religious liberty. Thus, most of us understand we can't practice human sacrifice, nor can Mormon fundamentalists have more than one wife or have sex with underage women, as Prophet Jeffords learned the hard way. As the Supreme Court stated in Reynolds v. U.S., concerning polygamous Mormons:"Laws are made for the government of actions, and while they cannot interfere with mere religious beliefs and opinions, they may with practices." Ms. Davis is free to believe what she wants about gay marriage, but as a government official charged with the implementation of laws concerning marriage licenses, she has a duty to issue the laws to all persons who are legally entitled to her. She has the alternative of finding a job more in keeping with her religious convictions.

As The Ghost and Vanilla Gorrilla just said, it looks like the Pope may have been set up--by whom and for what reason we don't know. The Vatican is no stranger to hardball politics, and it might have been an effort to create the appearance of the Pope's support for Ms. Davis's cause and/or to undermine the Pope by conservative elements in the Church who are still hostile to Francis. If he thinks she's right, I think he's wrong.

    Right.

That is why when interviewed on the plane by Terry Moran, he said “I can’t have in mind all the cases that can exist about conscientious objection.”
(i.e. "no specific cases come to mind".)

Davis and her attorney tried to put a spin on this. The pope had no idea who she was. The vatican is pretty much calling her a liar. She's nothing more than laughingstock.

"The Pope did not enter into the details of the situation of Mrs. Davis, and his meeting with her should not be considered a form of support of her position in all of its particular and complex aspects," Vatican spokesman the Rev. Federico Lombardi said in a statement issued Friday morning.

Davis' lawyer, Mat Staver, had said the audience lasted 10 minutes and was just between the Pope, his client and her husband.

"Such brief greetings occur on all papal visits and are due to the Pope's characteristic kindness and availability. The only real audience granted by the pope at the nunciature (embassy) was with one of his former students and his family," Lombardi said. http://www.cnn.com/2015/10/02/us/kim-davis-pope/

Her mother held the position for almost 40 years and Kim Davis worked under her mother for 26 years; her son works in the office with her now.

Probably, no one else wanted the job.

Her mother had been county clerk for nearly 40 years before her, and for 26 of them Davis had worked under her as deputy. http://www.washingtonpost.com/news/morning-mix/wp/2015/09/02/meet-kim-davis-the-ky-clerk-who-defying-the-supreme-court-refuses-to-issue-gay-marriage-licenses/

Just look at Meliai's comments. Kim is middle aged, and fat. Clearly that's part of it. Generally, it's as simple as the fact that Kim's values/agendas differs from theirs.

I don't know how her constitutional right to religious expression conflicts with her role in the government which constitutionally must try to be separated from religion.

But, you ask that question as if the constitutionality of her actions should make a difference to most people who dislike or hate her because of her anti gay marriage stance. The issue for many is that she is doing something they find awful. When such people bring in the constitutionality or legality of her actions they are watering down the moral aspect of their stance against them. Basically, what many are implying is, "what she's doing is illegal, and this happens to be an illegal act that I don't condone". They'd rarely change their mind if the law or constitution was changed, they'd simply change their focus from her, to the focus of changing the law or constitution back to where it more suited them.

In response, the Florida-based Liberty Council, which is providing lawyers for Davis, released a statement Friday defending the Davis camp's characterizations of the meeting.

The invitation to meet with Francis "was first conveyed to Kim Davis and her lawyers" on Sept. 14 and confirmed by the Vatican on Sept. 23, the statement said. The Vatican sent a car for Davis and her husband on the following day to take them to the embassy.

"Kim and Joe Davis waited for the private meeting with the pope," the statement said. "There were no other people in the room. This was a private meeting between Pope Francis and Kim and Joe Davis."

but the pope did give his opinion and his opinion he gave is: Conscientious objection is a right that is a part of every human right."

So did she cease to be human when she took the job or is she part of the group we call human?

the above post is just red herring spin

Pope didn't write the constitution, doesn't vote here and has no idea how this government works. (--it doesn't very well these days--another story. ) Conscientious objection has meant objection to killing others during war. Not for doing an elected job.

Its not being able to do the job under the 'changed' legal opinion that technically is not yet enforceable as law.

The argument is a moral one, no one has disputed that. The argument is also a legal one. No one has disputed that.

    Riddle me this:

If you got a job for 30 years and were in a position that required you to sign your name to licenses and everything was going along just ducky then all of a sudden the supreme court decided the states have to issue licenses to allowing adult men to have sex with 5 year old kids would you put your name on those licenses to officially certify them under the new law for all of history through all of time to see?

Would you do it? this is a yes or no question.
    yes____ no____

Would you feel you were cheated because the government changed your original contract and made a law that went against your moral values?

Would you simply cowar away in shame and hide under the table or get your attorney and fight it all the way to the supreme court?

Kim Davis and her attorneys have no credibility what so ever.

They lied about a photo, saying that it was "Ten Thousand People Praying For Kim Davis In Peru".

They were finally forced into the truth when the photo was identified as being taken during a jesus convention and posted to Facebook in May 2014.

that may be what you are familiar with but that is not its only application. It applies anywhere morals are concerned since morals are a persons religious statutes.

Do not bring Pedophilia into this discussion. That's off topic and posted to cause arguments.

Marriage License issuance is not a license for Pedophilia.
