The Oath Keepers wanted Trump to invoke the Insurrection Act so that they could have (in their perception) a legal insurrection to overthrow the legitimate 2020 presidential election.
Rhodes' attorneys have been trying to argue in court that Biden's win was an insurrection and that, therefore, Trump should have invoked the Insurrection Act to quash the 'insurrection'. Trump never invoked it the Insurrection Act, so the twisted defense claim doesn't matter. Even if Trump had invoked it, rational-minded people would have agreed that it should have been used to stop Trump's supporters from attacking the Capitol.
Rhodes and others can contend that Trump 'thought about' invoking the Insurrection Act; therefore, he did.
