yeah, that is totally unprofessional, but the teacher and the boy had sex three times. Doesn't sound like he didn't want it, so could it really be considered molestation if he was probably enjoying it? They had sex in a car, for goodness sakes. How is this unfair? HE wanted sex. HE got sex. Isn't wasn't even on school property. It is understandable that the teacher would get in trouble. But Why does the student not get in trouble. He was consiously having sex with a teacher, and he does not get as much as a detention. Of course, this is all assuming the worst for the student, that he had sex for the sake of sex then reported the teacher for no reason, and even this is assuming that he was the one who reported. Now, if he truly felt taken advantage of, it would be fair for him to report and the teacher be punished. However we do not know whether he felt this way or not. So, the fair thing to do would be yes, punish the teacher and assume that yes, the student felt taken advantage of. So this should happen to that teacher. HOWEVER if we knew perfectly well that the student willingly agreed to the sex and felt no regrets, no matter the gender of the teacher, there would really be no reason to punish the teacher except for unprofessional conduct. However, since we are not mind readers, and the student reported, we must assume that he DID feel molested and that the teacher is at fault for molestation. So, I agree with you on the fact that the teacher should be punished, but due to the sexual history between the teacher and the student, its kinda hard to beleive it was molestation.
and the teacher WAS punished. 3 years house arrest, 7 years of probation. and she is now registered as a sex offender. I would like to see her try to get another teaching job now.

That is why it is against the law, because other wise the adult would say it was consensual sex, hence it would not be considered molestation. However, if was consensual sex, why should that be against the law? Yes I know that a teenager's brain is not fully developed so he's not on par with an adult, hence not making them a good match for sex, but a teenager is still capable of making desicions, so shouldn't they allowed to do so? Yes, I understand that it is the law, this is totally illegal, but to me, the law does not make sense.

The reason the body didn't get in trouble with the law (I'm sure his parents have something for him) is because he could (assuming Flordia state law is the same as the law here, or about) have sex legally, and nobody would blame him anyway because is not an adult and its any easy defence to say he is immature and didn't know what he was doing. He probably did know what he was doing, but the point of having a system where people under 18 are minors is they aren't adults and aren't tried as adults... even though there is great difference in each individuals maturity level. The system is look biased... I wouldn't call it sexism, because both genders serve on jurys now. The jurors might be sexist, but they don't care about that kind of thing. Sexism, racism, they just let it happen, even if they know that it happens. Like for example: blacks are executed 4.3 times more often than whites, because of racist jurys, but they wont do anything about it. So once they make the death penalty illegal (might take some time), then they might start fixing this bullshit... or they could just fix racism and be completely ignorant. We'll see.
if the student was underage then he wouldn't be held accountable, it would be rape and child molestation. the teacher overstepped his boundaries and should be fired and arrested. i was a rape counselor and those were the guidelines we went by. hippiewise angel
Whether the student wanted it or not, it's still considered child rape and still against the law... and teacher's shouldn't take advantage of their students that way, either. It looks bad all around.
