busted - hardcore!

my fiance's brother is a sophomore in college. his off campus apartment got raided this morning and he got busted with over 5 pounds of pot and $4000! apparently they have had him under surveillance for about a year, and have video of him making a sale. so he was arrested for possession with intent to deliver for the 5 pounds, and delivery of a controlled substance from the investigation from june 2010. he spent part of the day in jail and i guess his parents bailed him out by sending $2000, his bail was set at $40,000.

he's kinda fucked. i feel pretty bad for him. we all knew that he smoked, but i never thought he was selling it. and certainly not that fuckin' much! ballin'!!!:afro:

but seriously, this is bad news. i guess he met with a lawyer today who thinks he can get him off any jail time. NORML lists the state law as 1-5 years and/or $15,000 fine for sale of 'any amount.' not very specific. it IS his 1st offense, so hopefully they won't go too hard on him. it's next to impossible that he won't get kicked outta school.

Do you know the lawyer? Does he specialize in this? Can he show you or can you find similar cases? It's hard to find good lawyers that you can trust. Try to check up on him.

People will sometimes hire the first lawyer who tells them what they want to hear-not what they need to hear.

 

If they put a year's work to building up to a bust then they are not very likely to want to go easy on him. "Kinda fucked"? My sense is that he's in some incredibly deep shit. They might offer him some sort of "deal" to turn in bigger fish. That sucks big time. Needless to say, he's probably no longer a sophomore in college.

 

He'll be able to finish school in prison would be my guess

i had a buddy that was busted last year with a couple pounds and intent to distribute in missouri (real harsh laws) and he was able to stay out of jail, stay in school and was just put on probation + community service

if this dude gets put on probation, he better stay sober, because they WILL fuck him in the asshole if he disrespects the judge and gets fucked again (i know this from experience)

 

wtf it pisses me off that they do that, especially for so long..go take care of crack and meth heads instead. sucks for him though. wish him the best :/

yeah, it's fucking ridiculous the resources that they waste trying to stop the cannabis trade. i've recently been bitching about the failed war on drugs and the patriot act more often than usual. i wouldn't be surprised if they used the patriot act in a way to get him

Shitty buzz though, hopefully he can finish his school some way and not let his life get too fucked up by this.

 

Why would you have 5 in one place? I mean, a pound, maybe... Sounds like he was obvious and dumb. I mean we can all get watched/setup, but if he's been this obvious for a year, and instead of cleaning his act up got worse and worse, and had 5 pounds in one fucking apartment...

Anyway, he better NOT skimp on a lawyer, he's looking at potential life I'm pretty sure... And he's OUT of school.

 

he seriously needs to contact NORML they offer specialty lawyers who may be able to help him with his case. seeing that they have been canvassing him he was apparently i high level dealer in that area that means they will use him as an example and give him the largest punishment possible. you can do some research on the lightest judges on drug charges and petition to change judges if you can find grounds to do so . the same can be done for any radical minded jury. honestly it will require a lot of time and effort that a lawyer can help with. potential life? no, there is no life sentence for marijuana distribution.

it is very likely that he is put on an intensive probation, sent to drug classes and lots of community service - all while being able to retain financial aid/go to school

there really is no higher classification for possession. with over 35 grams (most states) you are on a felony trial and more likely to be tried for intent to distribute. often lawyers can fight the intent case, however the fact they've seen him make a sale is gonna make that impossible - he still probably won't see a whole lot of jail time. maybe a week-month of shocktime. i wouldn't be surprised to hear he gets a 4 year probation

 

Ehh I dunno about where you live.

I'm pretty sure both my state and federal guidelines do offer 99 years, at least... In my state, I think it's 5+ pounds= 5-99 years mandatory... Could be wrong, I wouildn't know as I'm not walking around with 5 elbows...

i just checked, there is a "life" sentence but it is 100kg+
they definitely don't sentence dealers in for life, it is even less likely that they serve all the years they are sentenced for.

 

Well yeah, selling some weed probly won't put you up forever. But I'm just saying he needs to watch his shit and take it seriously, it's a potentially life wrecking thing to happen. Hopefully it's his first offence, and he BETTER keep his nose clean after this.

even if he gets caught with a sack 10 years down the line, he wont get much more than 2 years probation...typically though i've seen the older potheads get super cautious and they definitely aren't in their cars long with weed

 

damn and i thought about selling weed at one point for the future, that throws that idea out the window.

 

Honestly this is bad advice but it's really not that hard to keep it on the dl. When you buy in bulk go immediately to your stash then just take out small amounts as needed. Also only deal to freinds/aquintances, thats the biggest one.

You can make some pretty decent money for very little work.

 

There's a huge different between selling weed and essentially being a weed trafficker. Most people who sell pick up an ounce, two ounces or whatever at a time. Having 5lbs of weed is as someone else said playing with fire, that's the kind of thing that gets the DEA on your ass. Most people get busted making a sale, or in a random car stop while happening to have weed on them, not after a year long police investigation. Hell never have enough weed on you that it can put into place mandatory minimums.
