So it's about 3AM and I am headed home, and not paying attention to my speed. I get pulled over for 52 in a 40, no too bad, I never speed, just tired. I quickly put my eighth of weed into my center counsel and pull over. My windows are tinted, so I know he can't see anything. The cops comes to my window and says "I stopped you for your speed, but first of all how much marijuana is in this car?". "none officer" I say. He tells me he can smell it and says he is going to search my car. I say "I do not consent to any searches". He gets this puzzled looks and says it dosn't matter smell is probable cause to search and I should just make this easy on me. So this cop is lieing to me. In my state smell is not probable cause, what he wants me to do is consent to a search when he says he will search, I give up my rights when I do that, but I hold my ground, and say once again I do not consent to any search officer. He huffs off back to his car saying one will happen. But a few minutes later he walked back with my speeding ticket, and as he is about to let me go he starts pressing me again saying he can still smell pot and do I have a MMJ card, I am being difficult and all this. Eventuly he lets me go, I don't think anyone has had the balls to tell him no before, but I know my rights:sunny: Don't speed with drugs kiddies.

Wow, that's friggin' lucky that smell isn't probable caue in your state otherwise you'd be screwed, but good for you for knowing your local laws & standing your ground to protect your rights. Wish I lived in a state like that, I'd do the same but hopefully it won't ever have to happen...
I havent smoked weed in a car in least 10yrs... Havent smoked a ciggerett either .... I hate when someone even tries to get in my car smoking.. and then be all WTF when i say put it out...
I'm in Denver, CO So I thought worst case is he gets a drug dog, and I get the same fine for possession of less then an oz that I would get if I flat out tell him, so why not make him do some work.

Thanks It has made the fine from a ticket almost worth it just to know how mad I may have made that cop. The fact is that my car is private property so unless you have a warrent I am afraid you wont find my meds officer.
it's good to see someone actually using their rights during a traffic stop, not just giving them up. it seems that many people do fall prey to cops' trickery and lies, somehow justifiying their own actions of waiving their rights. there have been people on here that maintain to just let the police search because it'll appear that you've got nothing to hide. fuck that! you obviously did the right thing by saying you dont consent to any searches, and then repeating that statement. but next time, watch your speed if you've got weed in the cabin of your car. especially at 3am... better yet, just put it in the trunk and make sure you dont smell like weed yourself. either way, nice goin'...
Yeah for sure. I will not be that stupid again, I was just not paying attention on a downhill and he got me. My first ticket though so they sent me a letter in the mail saying I don't have to go to court if I pay a fine and plead guilty to a reduced ticket by mail. So I have that at least
I bet when he went to his car he got on his radio and was like "This stoner knows her rights, what do i do?" And the guy on the other end was like "Stop fuckin with me man."
True, but he can not search that area without being able to search my car in the first place, and I thoguht if he gets a dog it will be found regardless, in my state the cop CAN search my car if he sees something in plan sight, but if he dosn't he cant.
