a cop found a roach (which had no actual marajuana just paper) and a pack of joint papers (with tobbacco and a ciggarette rolling machine and filter tips) with some crumbs of weed in the corner of the packaging. theses things are actually remenants from very old times and i told them i had no weed so they could search with my blessing. It pisses me off that they actually wrote me a simple possesion and a paraphernalia ticket, but does anyone have a court experience and know if i can explain to the judge that i did not actually "posses" that shit, it was just shit in my dirty as fuck car.
i am by no means an expert on the law, but my hunch is that ignorance (e.g. that you're car is dirty, that the crumbs are 2 years old, that you didn't know it was there, etc.), while true, won't work well in court. you're best bet is probably to acknowledge your mistake, that it was dumb, etc. (even though you'd be biting your lip the whole time) and explain to the judge that you are a reasonable, respectable, educated, active, and otherwise law abiding citizen (i assume you are) that doesn't deserve a full punishment. those are my thoughts...maybe someone will have something more informative for you.
