getting threatened at work by an illegal immigrant

Alright so this guy at work, (he's about 4'11" doesnt speak any english, and
claims to be from El Salvador) threatened me 3-4 times with physical abuse and battery with a knife. The first time, he held a knife up to his throat and pointed at me saying "No Bueno" (no good), the second time he started pushing me then grabbed me by the shirt and held his fist up like he was going to hit me.. Those times I kind of just brushed it off cause I thought it was kind of funny.

So today, I was talking to my friend about the UFC match last night, and I did a little boxing motion, right when this guy walks by, he thinks Im talking about him, but he doesnt speak english, so he picks up a butcher's knife, puts it back, then comes running towards me swinging, a couple guys had to drag him out of the kitchen.. I told the boss later, and he talked to him, and said that it wont happen again, but I'm thinking thats not enough, even changing shifts so we dont work together isnt enough. The guy is obviously an illegal immigrant, there is already 1 illegal working as a cook there, this guy only has a first name, "Frank" which he doesnt know how to say or spell, doesnt speak any english, I know for a fact that he drives without a license everyday. I'm thinking about filing a report with immigration, but i'm not sure if that is the best idea.

I've just had it with his shit, and my work place isnt willing to fire him.. do I start a case against my workplace for hiring illegals?

Well if he really is illegal call immigration. Or call the cops.

Or do what I would do and just beat the shit out of his foreign ass.

 

Don't call the cops or immigration if you enjoy your job, because you will loose it if you do.

Talk to your boss about it, and tell him that you want the guy fired... as simple as that. Don't make any threats to call immigration or such if he isn't fired, but don't say that you won't do so either.

 

see im not much of a fighter, the only fight ive ever been in someone knocked me over from behind, if he hit me it would have been a different story, but right when he was about to they dragged him away.. I really want to, but I dont want an assault charge, and lose my job and everything.

I'm just not sure if he is illegal, I know he doesnt have a license, only has a first name, and doesnt speak any english.. The place I work at is a real old school diner, so they still pay illegals under the table now and then, and barley comply with food safety standards.. So it's hard to tell but if I knew I'd love to get his ass deported

 

I did talk to my boss, and he just said "it wont happen again dont worry about it"

and if he did fire me for contacting immigration, wouldnt I have sufficient grounds to at least claim unemployment? if not more?

He'd probably invent a different excuse for firing you.

Plus, he could be shut down or at least fined heavily for employing illegals.

Ofcourse.Well atleast in Britain thats constructive dismissal.refusing to provide a safe and habitable working environment.You could also sue for nervous shock, distress etc etc.

I don't know if immigration would do much good,it seems the US wants to make these people citizens now which is really pathetic.

 

Hmm I think initially just politely insist with your boss, that u can't have staff being threatened by a nutcase.Least of all probably an illegal one.

Legal proceedings might be alot of hassle that u might wanna avoid- I assume?

I'm the sort who'd deal with the midget myself.But failing that, I think your boss would see sense if the cops were gonna get involved?

its called TRO (TEMPORARY RESTRAINING ORDER). I dont know really tho, either way its a grey area because, if you do act on it and do something that your boss finds insulting he will fire you. If you dont do something, well then you may be putting your life or your safety at risk. Guess ya need to figure out which is more important.

The guy sounds so ignorant that if you did file a restraining order on him, the stupid prick would still fuck with you. He fucks with you (if you get the restraining order) and you call the police, the police come and will usually arrest him for breaking a restraining order, he gets charged with a misdemeanor, maybe even a felony. Once he is in the "system" Immigration usually will come in and politely escort him back into his own country.
