Going to court, need advice

    Unfortunately I was stupid enough to try to steel, and I am going to court for the third time, and I really dont want to have probation, Im fine with jail but probation would mean not being able to call my dealer cuz they get a list of people you call, no drugs and no leaving state. I have one idea, to tell the judge I did it because of stress at home, I DO have a bad home life, my mom is lazy and doesnt care about how much food we have or if the house is clean... my house is just plain gross. But I dont know if the judge would think of that as a good reason, so I dont know what I should say, I am willing to do ANYTHING but probation, any advice?

    I would go to jail over 1-3 years probation any day.

    Young and stupid? I have been to jail 3 times, 1 day 3 days and 7 days all for probation violation, its not scary, just boring as hell. With jail it is out of the way, community service I would be helping me city out, with probation I am watched and cant do anything at all... What sounds worse?

    well.. considering you are 16, you went to juvi, not real jail.. So in that case id take jail over probation.. but.. dont think jail isnt bad and you can just keep fucking up because once your thrown in big boy jail, its really not so fun, and its alot worse than boring..

    I hope the 3 other convictions were not for the same thing and really whatever it is you attempted to steal unless its food or personal need items like tampons, pit stick or something like that it wont hold much water for ya.

    I would have a hard time having pitty on a 4th conviction and the person is 16 and there was not some serious track work layed out to show you were anything but a dumb ass (not saying you are).

    I think I would if I was trying to get out of a jam and my arrest is for theft I would first tell the judge that you have issues at home, you want help for it, you figure you owe your community and for that you desire to do real community service to repay that portion back and you do understand no matter what you know right from wrong and feel you do owe some jail time for that but above all you would like the help you need from a professional.

    Maybe you should instead spend your time wondering how you can change your fuck-up of a life rather than how you can keep in contact with your dealer.

    And blaming shit on a "bad home-life" is fucking undignified.

    Advice: You did it, confess, take the probation, clean up your act. You've pretty much admitted you did it, now don't try to weasel out of the consequences.

    you tell the judge that and you think your home life is bad now,, just wait till DFCS gets involved..

    oh and believe you me they will..

    take your probation an keep your nose clean.. otherwise your still going to wind up on probation with DFCS involved..

    if youve already been in court over this an he aint sent ya yet,he wont send you to juvey now,, aint gonna happen unless you make it happen by fucking up again.

    he aint just gonna send you cause you dont want probation..

    you want advice, i just gave ya some..

    i know i was there not long ago....(as a parent)

    Do the time, fuck probation. ive been to jail 6 times and never once offered probation cause i live in Harris County in Texas the strictest in the country. All mine were victimless crimes and set up a couple times. Yeah jail aint that bad if your like us and you fit in.

    Well, I will be 17 when I go to court so I could end up in real jail, and THAT would be really lame, I dont know how it is there but my uncle is a guard there so it would be a embarrassing moment in my family history.

    The only thing fucked up about my life is that I can be stupid enough to try to steel, you have no idea how pathetic my house is... when you see your 400-600? pound mom eating non stop, leaving butter and milk out of the fridge cuz she says it wont hurt it, and always have to worry about if when you wake up.. if she will still be alive or not. THEN come see me. And yes I did admit it, I told security exactly what I did and gave them the stolen items before they asked for them, Im not trying to weasel out, I just want to not be seen as a piece of shit that needs to have the book thrown at him, I know what I did was wrong and dumb, I have no thoughts of steeling again.... but they wouldnt believe me if I said that, they would just say " thats what they all say."

    Meh, it's your life to waste, not mine.

    But I will give you some general life advice here, or more specifically what I would do to make the best of this situation.

    1)Quit smoking weed.
    2)Go to court, plead guilty, take my probation - they are doing what is going to be best for you. This is your third offense, apparently the 2 day stints aren't helping you. Maybe this will. While you can describe your family life, asking people to take pity on you is as I said undignified. You'd be better off explaining how you're trying to change your life (hopefully this isn't a lie), and how this was a momentary lapse in judgement, and how you're here to accept the consequences for it.
    3)Finish school, and if you're smarter than you seem here, try to go to community college. If you're not super-school oriented, get a trade. There isn't anything wrong with this. Be a productive member of society. Show some of the qualities that make good people good.

    im telling you,,.. the judge WILL NOT send you to juvey..
    you said you have already been in court 2 times over this,if the judge was going to send you to juvey you would be there now..

    i spent a year and a half, no fewer than12 times in court over my sons shit before i got fed up and told them fuck it they can have him..(he went into foster care instead of juvey where he should have went)

    i can tell you first hand,you sit in court all day for a few days you see how it works pretty quick.

    the juvenile justice system is a fucking joke.. 2 prior felonies aint shit.. theres kids with 12 that dont wind up in juvey.

    my son had 5 felony convictions before he was 18 and only spent less than 60 days total in juvey,most of that time was because i refused to come get him when he was arrested..

    the way i see it you have 2 choices, take your probation, or involve DFCS in your home life an take your probation .

    the latter will guarantee a nightmare for your home life and could easily have you yanked out of your home and put in foster care..

    so probabtion with DFCS crawling up your familys ass, or probation..those are your 2 choices.

    my advise,take the probabtion,an keep your mouth shut about your home life.

    or you could go commit a extremely violent felony,, before you go to court, then theres a chance the judge will send you to juvey for your shit..

    as i was told,
    "the juvenile justice system is not about punishing children for there acts,its about rehabilitation". PFFFT..

    as far as bein tried as a adult

    the crime was committed when you were 16 just because you turn 17 before sentencing doesnt mean the judge can send you to adult court system..you were charged as a juvenile you will stay in the juvenile court system..

    just ignore everything else youve read in this thread..

    i know the system well...

    You know what the sad thing is...all of these kids out getting arrested for stupid shit like stealing and drugs...are the ones who will be running the world someday.

    Kids aren't smart anymore. It's rather pitiful...

    My advice is to tell the judge that you are a member of the black panthers, and as such you do not believe in his system of justice. It is simply an organization to create a prison industry in which to enslave a third of african american men.

    Tell him that his court is a sham, and he should be embarrassed for being a slave trader in a fascist incarceration machine. That you will not respect him untill all your brothers in prison are tried by their peers, with lawyers of their choice.

    You've gotta push Judges around so they respect you.
